The Hidalgo County Sheriff’s Office said a 5-year-old boy died following a November 25 ATV crash in Mission.
According to a news release, the sheriff’s office received a 911 call at 12:29 p.m. regarding an ATV crash on a private property near the 9900 block of North Iowa Road in Mission.
“Deputies responded to a local hospital, where they met the parents of two juvenile brothers who had crashed an ATV into a tree on their property,” the release stated. “The parents discovered the boys at the rear of the property and transported them to the hospital for medical treatment.”
The victim’s 11-year-old brother remains in critical but stable condition at a local hospital, the sheriff’s office said.
In the initial release, officials said investigators and crime scene specialists processed the crash site and spoke with witnesses.
The sheriff’s office said they are still investigating the circumstances of the crash, adding that anyone with information is urged to contact them at (956) 383-8114 or Hidalgo County Crime Stoppers at (956) 668-TIPS (8477). Anonymous tips can also be submitted through the application P3 TIPS.
Establishing fault for ATV accidents
When you or someone you love is injured in an ATV accident caused by someone else, you’d expect to be compensated. However, figuring out who may be to blame, and how to prove it was their fault can be tricky.
ATV owners, drivers, and parents of minor drivers have a duty of care to make sure whoever drives the vehicle operates it safely so as not to injure themselves or their passengers.
Property owners have a duty of care to make sure the land where enthusiasts drive off-road vehicles is free from dangerous conditions.
Manufacturers and distributors of the ATV’s parts and equipment have a duty of care to make the vehicle safe.
When a person or business violates their duty of care, they are negligent. When that negligence causes an accident, the injured victim has grounds to pursue compensation for their damages.
