SAN ANTONIO – Three people were injured after a semi-truck collided with another vehicle, sending the truck through the wall of a hotel, and into an empty swimming pool.

The crash happened around 3:00 a.m. June 11 in the 6300 block of IH-35 North, on the city’s northeast side. Police said a small black vehicle crashed with the 18-wheeler on the access road. The impact from the crash sent both vehicles off of the road and through a concrete wall of a nearby hotel, according to SAPD.

The sedan became wedged between the 18-wheeler and the concrete wall, while the 18-wheeler continued through the wall and into the empty hotel pool.

Police say the driver of the 18-wheeler was uninjured. However, two people inside the sedan, and a pedestrian were taken to an area hospital. The vehicle occupants were listed in stable condition, and the pedestrian was in critical condition.

It’s unclear what caused the crash, but the investigation continues.

Texas is an at-fault state

Texas uses what is called a tort liability system. This means that the insurance carrier of the at-fault driver will be responsible for paying out the claim.  Rather than turning to your own insurer no matter what, you may turn to the responsible party to cover your expenses arising out of the accident.

What does that mean for me?

At-fault auto insurance laws allow you to hold accountable the party that was actually responsible for causing the accident. Thus, if another party caused your accident, you don’t have to file a claim with your insurer and pay a deductible or risk higher premiums.

On top of that, if the other party doesn’t have enough coverage to pay your expenses, you may also be able to sue the at-fault driver to recover the difference.

However, it is important to note that if you are the party that caused the accident, you and your insurer will be responsible for covering the costs of any resulting damages.
