A 68-year-old woman was killed and two others were injured in an August 10 crash in Weslaco. The crash happened about 12:36 p.m. on Farm to Market Road 1015, according to a news release from the Texas Department of Public Safety.

The report states that the incident occurred when a green Chrysler Town & Country turned left off a private road to merge onto FM 1015. The vehicle was struck by a blue Chevrolet Silverado traveling south on the farm road. According to the report, the truck was traveling at a “high rate of speed.”

The driver of the Chrysler, 68 year old Sofia Hernandez of Edcouch, died of her injuries at the scene.

A passenger in her vehicle, identified only as a male, was airlifted to DHR in Edinburg. The driver of the truck was transported to the same hospital via ambulance. Their conditions were not immediately disclosed.

The crash is under investigation by DPS.

Texas at-fault accident laws

Texas is an at-fault state when it comes to car accidents. More precisely, it is a “comparative fault” jurisdiction. This means that any driver who is completely or at least 50 percent at fault for an accident has to take proportional responsibility.

This is why Texas law requires drivers to purchase liability insurance and carry proof with them when driving. It provides coverage in case of liability in an accident. The minimum coverage required in Texas is $30,000 in bodily injury coverage per person ($60,000 per accident) along with $25,000 in property damage coverage.

How do you prove fault?

This question is not only a question of law, but also a question of fact. Photographs, video, phone records, documents, crash reconstruction reports, police reports, and witness testimony are examples of evidence that can help prove fault liability. Determining fault in a traffic accident can be a complicated matter. Texas accident laws are confusing, and many facts must be considered in determining the amount of liability by each party.
