The dangers and consequences of street racing

In Texas, street racing can lead not only to civil liability, but to criminal charges as well. If a street race results in a bodily injury, the offense is considered a third-degree felony, punishable by 2 to 10 years in prison, and a $10,000 fine.

If a serious injury or death occurs, the street racing offense becomes a second-degree felony, with a penalty range of 2 to 20 years in prison, and a $10,000 fine. Defendants can also face civil liability on top of the criminal charges.

Negligence Per Se – In Texas, street racing is considered a crime and an act of negligence per se, meaning the racer is presumed to have been negligent by violating the law.

Compensation – Victims of street racing accidents can seek compensation for various damages, including medical bills, lost wages, pain and suffering, and property damage.

Insurance – Insurance companies may deny coverage for accidents caused by illegal racing, leaving the at-fault driver responsible for the full costs.

Police Reports – Police reports, including witness testimony, and evidence of the street racing, are crucial in establishing liability.

Contact J. Gonzalez – It’s recommended to contact a personal injury lawyer to gather evidence, preserve it, and help determine liability. If a death occurs, it becomes a wrong death claim.

Dallas woman faces charges following deadly street racing crash

By: Benjamin Treviño

DALLAS – Newly-released surveillance footage shows a May 11 street racing crash that turned deadly in Dallas. According to police, a speeding car lost control and slammed into a pickup truck, killing the truck’s driver.

Dallas police responded to the crash near the 5000 block of Second Avenue just before 8 p.m.

First responders found a blue Ford Fusion with three people trapped inside and an overturned pickup truck. A Justice of the Peace pronounced the truck driver died at the scene. According to police, the woman driving the sedan and her two passengers were seriously injured but are expected to recover.

WFAA reported that witnesses told police the woman behind the wheel of the Fusion was racing another car at a high speed when she lost control and crossed into oncoming traffic. The Fusion struck the pickup head-on as it traveled southbound on Second Avenue, causing the truck to veer off the road and flip over, the station reported. The impact was so intense, the Fusion’s engine was ejected from the car.

The woman driving the sedan, whose name was not immediately released, is facing a charge of racing causing death. Police said she will be booked into jail once she is released from the hospital. The full list of charges the driver may face had not been released as of this writing.
