Recovering damages from an alleged drunken driver

In order to recover damages from a drunken driver, the plaintiff must establish that the defendant’s negligence caused the crash. The plaintiff must also be able to substantiate the damages that were sustained as a result of the crash.

Evidence can include receipts for medical expenses, lost wages, vehicle damage, and pain and suffering.

If the victim dies, immediate family members can try to recover damages through a wrongful death claim.

In either case, the plaintiff(s) might be able to recover punitive damages if the court determines the driver’s actions were extremely reckless.

Proving negligence

Driving while intoxicated and causing a crash makes a compelling argument for negligence. Evidence for DWI negligence can include police reports, breathalyzer results, and witness statements.

The plaintiff must establish a direct link between the drunk driver’s actions, the accident, and the injuries and damages.

Evidence that proves damages can include hospital bills, doctor visits, medication, therapy, and any ongoing medical care.

A plaintiff can recover damages for lost income. This covers any income the plaintiff missed due to the injuries, including future lost earnings. Furthermore, a plaintiff can seek compensation for:

  • Vehicle damage
  • Property damage
  • Pain and suffering
  • Punitive damages (in cases of extreme negligence)

When seeking compensation, a plaintiff can file a claim with the drunk driver’s insurance company to seek compensation for damages.

A personal injury/wrongful death attorney can negotiate with the insurance company to reach a fair settlement. If the insurance company refuses to make a satisfactory offer, the attorney can file a personal injury or wrongful lawsuit against the drunk driver on behalf of the plaintiff(s).
