Pursuing tort claims against someone in jail
It is possible to pursue a wrongful death or personal injury claim against someone who is incarcerated, but this situation does present unique challenges.
Suing an incarcerated individual can be complicated and time-consuming. As an example, the usually simple process of serving the defendant with notice of lawsuit can be difficult, because inmates are often moved around to different detention centers. Such a case requires an expert attorney who understands legal nuances, especially concerning civil vs. criminal law.
Another issue is that Incarcerated people often have limited financial resources, making it difficult to collect monetary damages even if you win the case. They could be considered “lawsuit proof” if they lack the means to pay.
The incarcerated defendant also has limited ability to participate in legal proceedings and requires clearance from the correctional facility to attend, which can add delays and paperwork.
Even with these challenges and others, pursuing a tort claim is still possible. However, it will require the assistance of an experienced attorney.
