Can a resort be held liable for accidents on its property?

Yes. A resort may be responsible for injuries sustained on the property if management was negligent in maintaining safe conditions. To hold a resort liable, an accident victim generally needs to prove the resort had a duty of care, breached that duty through negligence, and that breach directly caused an injury.

Duty of Care

Resorts have a legal obligation to provide a reasonably safe environment for their guests. This includes maintaining premises, addressing hazards, and taking steps to prevent foreseeable accidents.

Negligence

If the resort fails to meet this duty of care, it can be considered negligent behavior. Some examples of negligence include:

  • Slippery floors without proper warning signs.
  • Inadequate lighting in common areas.
  • Unsafe conditions around pools or other recreational facilities.
  • Poorly maintained walkways and pathways.
  • Failure to address hazards like broken handrails.

Causation

An injured party who makes a claim against a resort must prove that the resort’s negligence directly led to the injury, or injuries, the person sustained.

Damages

If negligence is proven, the victim may be entitled to compensation for medical expenses, lost wages, pain and suffering, and other related damages.

Travel Insurance

If you have travel insurance, contact your provider to understand your coverage and claim procedures.

State Laws

Laws regarding premises liability can vary by state, so it’s important to have a basic understanding of tort laws in the state where the accident occurred.

What to do if you are injured in Texas

The J. Gonzalez Law Firm recommends you first seek medical treatment for your injuries. You should report the accident to resort management and document the incident.

You should also gather evidence. That includes taking photos or videos of the scene, getting contact information from witnesses, and keeping records of medical expenses.

Once you have done these things, we recommend you contact us for a more detailed assessment of your right to seek compensation. It won’t cost anything to have an initial consultation, and you pay nothing unless you received the compensation you deserve.
