Can the family of a vehicle passenger sue the driver for wrongful death?
Yes, the family of a passenger killed in a car accident can sue for wrongful death if the accident was caused by someone else’s negligence or misconduct. This allows them to seek compensation for their loss.
A wrongful death lawsuit is a civil lawsuit filed by the surviving family members of someone who has died due to the negligence or intentional actions of another person or entity.
In Texas, the surviving spouse, children, or parents of the deceased can file a wrongful death lawsuit.
To be successful in a wrongful death claim, the family must prove that the other party was negligent, reckless, or otherwise responsible for causing the death of the passenger.
Damages in a wrongful death case can include funeral and medical expenses, loss of future earnings of the deceased, and compensation for the loss of companionship.
Texas law allows for wrongful death claims based on wrongful acts, neglect, carelessness, unskillfulness, or default of the responsible party.
It’s important to note that Texas has a statute of limitations for wrongful death cases, meaning there’s a deadline to file the lawsuit (usually within two years of the death).
