Newtown Tragedy Brings Brain Injury to Light
Posted on Thursday, January 3rd, 2013 at 11:28 pm
In 2008, the Center for Disease Control released a statistic revealing that the causes of brain injury stem from:
- Assault (37%)
- Auto Accidents (25%)
- Sports Activities (11%)
- Falls (11%)
A different study revealed that 87% of those incarcerated in American jails suffered from brain injuries as well. Adam Lanza, the man responsible for the Sandy Hook Elementary shooting, allegedly suffered from Asperger’s Syndrome. Tests are currently underway to determine if he had suffered any sort of brain injury, which may have led to the devastating shooting.

Crushed Leg from Fallen Crucifix Results in $3 Million Lawsuit
Posted on Tuesday, December 4th, 2012 at 5:57 pm
43-year old David Jimenez of New York suffered serious injury to his right leg after a 600-pound statue of Christ crushed it, leading to an amputation. Jimenez had been cleaning the statue at the St. Patrick’s Church in Newberg when it toppled and landed on top of him. Allegedly, only a single screw had been holding the statue in place. The church has claimed that it is not liable for the accident. Jimenez filed a $3 million lawsuit in March of 2011. The trial to determine the outcome of the incident is expected to begin in late 2012.

Text Messaging Declines, Texting-Related Auto Accidents Don’t
Posted on Monday, November 26th, 2012 at 7:04 pm
NBC News has cited Chetan Sharma’s US Mobile Data Market Update, which claims that text messaging amongst users has dropped from 696 texts in the second quarter of 2012 to 678 in the third quarter. Despite this, the National Highway Traffic Safety Administration has released a statistic showing that cellular phone-related deaths, which include auto accidents associated with texting, still continue to rise. The NHTSA’s numbers seem to suggest that Sharma’s statistic is incorrect. Despite this, auto accident attorney Richard Console, Jr. urges drivers to take caution and not text while driving.

Unborn Child Listed in Wrongful Death Suit
Posted on Tuesday, November 13th, 2012 at 5:17 pm
Christopher Schmidt, his wife Diana and their three children (one unborn) were tragically killed on September 9th after truck driver, Josef Slezak, crashed into the rear of Mr. Schmidt’s car at 75 mph, causing him to crash into his wife’s car in front of him. The children were in Mrs. Schmidt’s car. The entire family was killed instantly. The parents of the Schmidts filed a lawsuit against Slezak, his employer, two other truck drivers who had caused a delay in traffic that the Schmidts were stuck in and the employers of those truckers as well. This is the first wrongful death suit to include an unborn fetus due to a Nebraska law extending legal protection to fetuses at any stage in development.
Slezak has been charged with four counts of manslaughter, 4 counts of vehicular homicide and a single count of vehicular homicide of an unborn child. He is currently awaiting trial in a Cheyenne County District Court.

Determining Legal Liability: The Rule of Carelessness
Posted on Wednesday, October 10th, 2012 at 9:38 pm
In almost any accident, fault hinges on who acted the most careless. This “rule of carelessness” is often the determining factor for settlements when it comes to awarding damages and other forms of compensation. Other considerations for determining who was at fault may include:
- Whether or not the injured party was somewhere they should not have been
- Whether the person who caused the accident had no “duty” to be liable for the injured person
- Comparative negligence is also considered where the injured person’s damages may be reduced because they were also liable for causing the accident.
- If a person displays negligence while working for someone else, the employer can be held negligible

While there are always two sides to every story, determining who has acted carelessly or in a negligent manner could mean the difference between receiving compensation for your pain and suffering or not. Houston Police Kill Double Amputee
Posted on Tuesday, September 25th, 2012 at 4:21 pm
Houston police shot and killed a double amputee after he threatened police with what turned out to be a pen. According to the Houston Chronicle, the shooting occurred early on September 22 at a nursing facility for the mentally ill. Police were called when resident, Brian Claunch, became aggressive after an employee refused to give him a cigarette and soda.
Claunch, who sits in a wheelchair, then cornered a police officer into a corner and attempted stabbing the officer with an object. After repeated requests to drop the object, the cornered police officer shot and killed Claunch. The object was later found to be a silver pen. Claunch had previously been diagnosed with schizophrenia and bipolar disorder and was missing an arm and a leg after a train accident.

Texas Teen Killed Before Testifying in Rape Trial
Posted on Friday, September 14th, 2012 at 3:52 pm
Police have charged a North Texas man with capital murder after he admitted to killing a teen that had a sexual assault case pending against him. Franklin Davis gave a detailed account of how he murdered 16-year-old Shania Gray on September 6 after picking her up from school. Police say Gray had sex with Davis several times in 2010 when she was babysitting his children and subsequently filed assault charges against him. After picking the teen up from school, Davis says he drove Gray to the Champion Trail in Carrollton where he shot her twice. Davis added that as she lay in the river bleeding to death, Gray asked him “Why?” before he ultimately strangled her with his foot.

Suspected Drunk Driver Injures Teen Motorist and her Mother
Posted on Friday, August 31st, 2012 at 2:59 pm
A 21-year-old Corpus Christi man is facing intoxication assault charges after slamming into a sedan and injuring a teenage girl and her mother. The 15-year-old girl and her mother were riding in their Volkswagen Passat on August 19 in Corpus Christi when they were struck by a Dodge pickup around 7:30 p.m. After colliding with the sedan, the truck then struck a concrete wall.
The mother of the teen suffered a broken wrist, while the teen suffered only minor injuries. The driver of the truck suffered a broken ankle. An off-duty police officer witnessed the accident and told first responders that the truck was traveling at nearly 100 mph. The driver of the truck appeared intoxicated and was taken to a nearby hospital to have a toxicology test performed. Investigators will await the results before moving forward with any intoxication assault charges.
