Houston Police Kill Double Amputee

Houston police shot and killed a double amputee after he threatened police with what turned out to be a pen. According to the Houston Chronicle, the shooting occurred early on September 22 at a nursing facility for the mentally ill. Police were called when resident, Brian Claunch, became aggressive after an employee refused to give him a cigarette and soda.

Claunch, who sits in a wheelchair, then cornered a police officer into a corner and attempted stabbing the officer with an object. After repeated requests to drop the object, the cornered police officer shot and killed Claunch. The object was later found to be a silver pen. Claunch had previously been diagnosed with schizophrenia and bipolar disorder and was missing an arm and a leg after a train accident.

Texas Teen Killed Before Testifying in Rape Trial

Police have charged a North Texas man with capital murder after he admitted to killing a teen that had a sexual assault case pending against him. Franklin Davis gave a detailed account of how he murdered 16-year-old Shania Gray on September 6 after picking her up from school. Police say Gray had sex with Davis several times in 2010 when she was babysitting his children and subsequently filed assault charges against him. After picking the teen up from school, Davis says he drove Gray to the Champion Trail in Carrollton where he shot her twice. Davis added that as she lay in the river bleeding to death, Gray asked him “Why?” before he ultimately strangled her with his foot.

Suspected Drunk Driver Injures Teen Motorist and her Mother

A 21-year-old Corpus Christi man is facing intoxication assault charges after slamming into a sedan and injuring a teenage girl and her mother. The 15-year-old girl and her mother were riding in their Volkswagen Passat on August 19 in Corpus Christi when they were struck by a Dodge pickup around 7:30 p.m. After colliding with the sedan, the truck then struck a concrete wall.

The mother of the teen suffered a broken wrist, while the teen suffered only minor injuries. The driver of the truck suffered a broken ankle. An off-duty police officer witnessed the accident and told first responders that the truck was traveling at nearly 100 mph. The driver of the truck appeared intoxicated and was taken to a nearby hospital to have a toxicology test performed. Investigators will await the results before moving forward with any intoxication assault charges.

Cowboy’s Fan Sues Organization for Burned Bottom

A Texas woman is suing the Dallas Cowboys Organization after sustaining third degree burns on her buttocks while at a team scrimmage in August 2010. Jennelle Carillo of Cleburne filed a lawsuit in a Tarrant County civil court alleging that the organization was negligent for not having warning signs indicating that the marble benches outside of the stadium would be hot.

Carillo’s lawyer, Michael Wash says his client suffered “mental anguish, physical pain and disfigurement as a result of her wounds.” The suit goes on to state that bench “was uncovered and openly exposed to the extremely hot August sun. The combination of the nature of the black, marble bench and hot sunlight caused the bench to become extremely hot and unreasonably dangerous.” The Cowboys Organization has yet to comment on the lawsuit citing ongoing litigation.

Woman Stabs Fiancé Hours before Wedding

Police in Whitehall Township, Pennsylvania arrested and charged Na Cola Darcel Franklin, 31, with stabbing her fiancé to death mere hours before their wedding on August 11. According to the Express-Times, Billy Rafeal Brewster, 36, was stabbed to death by Franklin on the second floor landing of their apartment building.

Authorities said Brewster suffered two stab wounds to his torso which punctured his heart. Brewster was taken to the hospital, but later pronounced dead at 3:30 a.m. Saturday. At her arraignment, Franklin said, “I did not kill him on purpose,” between sobs. Neighbors of the couple say they had lived in the apartment with their three children for about a year. Authorities have yet to establish a motive, but Franklin now faces a homicide charge.

Ford Recalls 2013 Escape Models For Carpet Defect

Ford and the National Highway Traffic Safety Administration (NHTSA) have issued a nationwide recall of 2013 Ford Escape due to carpet padding that hinders use of the brake pedal. The move comes after an employee found that padding on the left side of the lower center console could stick out and affect foot placement on the brake pedal after taking the foot off the accelerator. The defect could cause problems with braking and lead to a crash.

Vehicles affected by the recall were produced between March 8, 2012 through June 7, 2012. Ford will notify owners affected by the recall and dealers will remove the padding and the left-side console trim panel and replace it free of charge.

Kids Lamps Recalled Due to Fire Hazards

The U.S. Consumer Product Safety Commission has issued a recall of Discovery Kids Animated Marine and Safari Lamps because of a problem with wires being too close to the circuit board and posing a fire hazard. The recall affects roughly 300,000 lamps having a batch number beginning with 584894 or 10128 and also contains one of the following model numbers: 1642433, 1641523, 1628626, 1645729, 1641522, or 1645853.

While no injuries have been reported, the lamp’s maker, Innovage LLC, of Foothill Ranch, California, has received 11 different reports of short circuiting including three which resulted in fires and property damage. The lamps were sold nationwide at retailers such as Bed, Bath and Beyond, JCPenney, Kohls and Toys “R” Us and also online on Amazon, Macy’s and Overstock.com between June 2010 and March of 2012. If you own one of the lamps issued in the recall, you are urged to contact Innovage for instructions on receiving a full refund.

Family of Slain ICE Agent Sues Government

The family of an Immigration and Customs agent is suing the federal government for $25 million in a wrongful death suit. Agent Jaime Zapata was slain in Mexico during a roadside attack near San Luis Potosi in northern Mexico in February 2011. The wrongful death claim was filed on June 14 by a South Texas law firm and defendants include ICE, the FBI, the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and the Justice Department.

The claim alleges that two AK-47 assault rifles were bought in Texas and smuggled into Mexico and were used to fire more than 90 rounds at the ICE agents. Operation Fast and Furious allows U.S.-bought weapons to cross into Mexico as part of border gun-trafficking investigations. The claims cite the operation to accuse ATF officials in Texas of knowing the identities of the men who used the weapons but failed to stop them.
