Fundamentals of wrongful death claims
A wrongful death claim is a legal action that can be filed by the immediate family members of an individual who died as a result of the negligent or intentional actions of another party. A wrongful death claim can be brought against an individual, or a business, or both.
These claims seek compensation for the financial and emotional damages resulting from the loss.
Eligibility
In Texas, the law defines immediate family members as the surviving spouse, children, and parents of the deceased. Only they have the right to pursue a claim. If there are no immediate family members, the executor or administrator of the deceased’s estate may bring the claim on behalf of the estate and other potential beneficiaries.
Establishing liability
To succeed in a wrongful death claim, the plaintiff has to establish that the negligent action(s) of the defendant was the primary cause of the victim’s death. That requires a thorough investigation of the incident, gathering evidence, and consulting with experts to build a strong case.
Damages
Recoverable damages can include:
· Funeral and burial expenses
· Medical bills and expenses incurred before the individual’s death
· Loss of future earnings and financial support
· Loss of companionship, guidance, and consortium
· Mental anguish and emotional suffering
The specific damages any plaintiff can recover will depend on the circumstances and the unique facts of each case.
