The enormous devastation that can be caused by traffic accidents came into sharp focus June 4, when a suspected DWI crash claimed the life of a mother, and left her two children orphaned.
In these circumstances, a wrongful death lawsuit can be brought by a number of parties. The parties include the surviving children, the surviving spouse, and even the parents of the deceased. If none of the individuals entitled to bring an action do so within three months of the injured individual’s death, the executor or administrator can bring the action, unless requested not to by all those individuals.
Additionally, a parent or legal guardian of the children can file a personal injury claim on behalf of any minor children who were hurt in the crash.
The objective of wrongful death claims and personal injury claims are essentially the same. They both seek to compensate victims for losses incurred because of the negligence of someone else. Losses can include medical expenses, pain and suffering, loss of income, loss of companionship, and more.
The deadlines are different for a wrongful death lawsuit, and a personal injury lawsuit. In a wrongful death case, the deadline is usually three months from the date of the victim’s death. Personal injury lawsuits must be filed within two years of the date the injury occurred.
Children who have lost a parent can experience a range of emotions, including grief, anxiety, and fear about the safety of their remaining parent or guardian. It’s important to provide them with emotional support and understanding.
