Lawsuit Filed by Beaumont Man After Rear-End Crash

Posted on Monday, September 15th, 2014 at 9:12 pm

Most drivers will spend the majority of their time on the road facing the front while regularly glancing to the sides. While this is done to avoid any sort of impact with other vehicles, a rear-end crash can be abrupt and dangerous.  Unfortunately, for a Beaumont, Texas man, the aftermath of a rear-end crash has prompted legal action against an alleged negligent driver.

A Fight for Justice

The man filed his lawsuit against a female driver in Jefferson County District Court after she struck the rear of his vehicle late last year. According to the lawsuit, the man was driving south on the 8300 block of U.S. Highway 69 when the woman hit his vehicle from behind, causing several injuries to his neck, back, ankle, foot and body.

The lawsuit holds the woman accountable for negligence for allegedly failing to control her vehicle, keep a proper lookout and take evasive action. The man is seeking damages for:

  • Medical expenses

Dangerous Roads

According to court records, the Galveston County woman filed the lawsuit against a man who struck her car, injuring her. The record shows the woman was driving southbound on FM 646 when the man, driving on the opposite lane, swerved into her path and collided with her vehicle.

A police investigation discovered the man was intoxicated at the time of the accident. The lawsuit cites the man with negligence after he allegedly failed to yield to oncoming traffic, properly brake and control his vehicle. The woman is seeking an amount above the jurisdictional minimum.

With so many road rules and safety procedures in place, a safe ride is always what any passenger expects. Unfortunately, for a woman in Austin, these expectations were not met.

Reckless Actions

According to official documents, on the evening of August 11th, police were alerted to a car accident in the 10100 block of South I-35, south of the Slaughter Lane intersection. When they arrived, authorities found that a truck had gone over the guardrail and lay overturned and wedged beneath a frontage road bridge.

The three occupants were found hanging upside down in their seats. While the driver and the front seat passenger were pulled out alive, the rear seat female passenger suffered serious injuries. She was discovered stuck between the roof of the truck and the bottom portion of the window. She was pronounced dead shortly after.

Police officers revealed the male driver stated that he had consumed a six pack of beer and rum before the group traveled back to Austin after spending time in San Marcos. The driver blew a .119 on a Breathalyzer test and has now been charged with intoxication manslaughter, a second-degree felony.

TxDOT Kicks Off “Talk, Text, Crash” Campaign

Posted on Monday, June 30th, 2014 at 4:01 pm

You’ve probably received a few texts or phone calls while driving, but have you ever answered them? Can doing so place you or other motorists in harm’s way? According to research from the Insurance Institute for Highway Safety, texting drivers are four times more likely to be involved in a car accident. With 505 deaths and 19,981 injuries attributed to distracted drivers reported last year, warning motorists about these dangers has become a huge priority.

The Texas Department of Transportation (TxDOT) is hoping to educate the public about the dangers of distractions while driving with the launch of the “Talk, Text, Crash” campaign.

Preventive Efforts

TxDOT, along with the National Highway Traffic Safety Administration, law enforcement, and local leaders, will be urging drivers to maintain focus on the road to avoid any potentially dangerous distractions. The “Talk, Text, Crash” campaign will host events across the state that will feature a car-sized, crashed phone as the focal point for guest speakers who will share their stories and offer insight into the texting-while-driving problem.

Campaign organizers are aware phone usage is not the only distracting factor in car accidents and will take a stand against other disruptions such as eating, drinking, grooming, reading, using navigational systems, and adjusting the radio. With these efforts, the campaign is looking to minimize the potential risks that exist on the road.

Trucking Accident Claims Man’s Life, Comedian Tracy Morgan Left Seriously Injured

Posted on Tuesday, June 10th, 2014 at 3:44 pm

The open road can be an intimidating thing to deal with, especially when the towering shape of a semi-truck appears when you least expect it. About 500,000 accidents are attributed to these massive vehicles every year and 5,000 of them result in fatalities. A truck accident can be devastating enough to completely change or end a life and can leave one’s family with the stress of paying medical bills and funeral fees. Unfortunately, for a group of people in New Jersey, a trucking accident has resulted in injuries and a death which are making national headlines.

Dangerously Tired

Famed comedian and actor Tracy Morgan was left seriously injured early Saturday when his limousine was struck by a Walmart semi-truck driven by 35-year-old Kevin Roper. The accident claimed the life of Morgan’s mentor and fellow comedian, James McNair, and resulted in serious injuries for three other passengers. Morgan, along with the three others injured, was hospitalized and underwent surgery to repair a broken leg. Reports revealed the comedian’s injuries included broken ribs, a broken nose, and a broken femur. According to Morgan’s spokesman, the comedian is in critical condition but has shown signs of responsiveness.

Authorities revealed the truck’s driver had been awake for over 24 hours prior to the accident. His fatigue allegedly kept him from noticing slow-moving traffic and led him to crash into the limousine, causing it to hit other cars, spin, and flip over. Roper was arrested and charged with vehicular homicide and assault by auto. He was released on a $50,000 bail Saturday night and is expected to attend court later this week.

Fighting the Damage

A trucking accident can leave you and your family with irreparable damage along with the debilitating stress of having to pay medical bills, car damages, and funeral fees. Affidavit Reveals Alcohol Involved in Roadside Collision

Posted on Monday, June 9th, 2014 at 3:06 pm

A flat tire can be one of the most problematic and inconvenient things a driver can deal with. Pulling onto the side of the road to change a busted wheel can put you in a highly-dangerous situation out of your control. Unknowing or negligent drivers can veer off their lanes at any given second and strike your car, causing catastrophic damage. Three people from El Paso know just how devastating an unfortunate event like this can be.

Danger Approaching

According to news reports, a 36-year-old man, his passenger, a 33-year-old woman, and their friend, a 30-year-old man, were injured as they changed their vehicle’s tire in the early hours of June 2nd. The man had pulled over onto the emergency lane of Loop 375 North and the friend followed suit to provide assistance. As the trio changed the tire, a 41-year-old man struck both vehicles, injuring all three. The victims were taken to the hospital along with the driver that crashed into them, who was later met by police.

The person allegedly responsible for the accident initially claimed he had tried to move away from the two vehicles he struck but wasn’t able to due to another vehicle being next to him. Upon further investigation, police found there were, in fact, no other vehicles in the vicinity at the time of the accident. The arrest affidavit additionally revealed the alleged wrongdoer had consumed several cans of beer before driving that night. He has since been charged with two counts of intoxicated assault causing serious bodily injury.
