DPS investigates fatal tractor-trailer crash

BROWNSVILLE – Investigators with the Texas Department of Public Safety (DPS) are looking into the circumstances of an April 18 semi-truck crash in Brownsville that left one person dead. The accident happened about 7:02 p.m. in the northbound lanes of Toll Road 550 in Brownsville.
Early indications are that the 18-wheeler was carrying “hazardous-flammable material,” and was being driven “at an unsafe speed,” according to an initial DPS news release on the crash.
The driver, who was not immediately identified, apparently lost control of the vehicle, but it’s not known if speed was the only contributing factor. According to the news release, the big rig struck a concrete barrier, rolled on its side, and burst into flames.
The driver was pronounced dead at the scene.

Sullivan City man dies in motorcycle crash

The Texas Department of Public Safety (DPS) is investigating a fatal motorcycle crash that happened April 8 in Sullivan City at approximately 10 p.m. A DPS news release indicates the crash happened on El Pinto Road south of La Pinta Street.
The preliminary investigation indicates a blue and red Polaris RZR was traveling north on El Pinto Road while a red Honda CRF motorcycle was traveling north behind it.
The motorcyclist, 22-year-old Sullivan City resident Rodrigo Hernandez, failed to control his speed and rear-ended the Polaris, according to the DPS report.
Hernandez was ejected, hit the rear of the Polaris, and died at the scene. DPS continued to investigate the crash as of this writing.

Cameron County crash leaves one dead, one injured

CAMERON COUNTY – The Texas Department of Public Safety (DPS) reports a motorist was killed and his passenger was injured when their truck collided with an 18-wheeler. The crash occurred in the early morning hours of April 6 near the small community of Santa Maria, according to a DPS news release.
The release states that 44-year-old Pedro Omar Gutierrez was driving west on Military Highway 281 in a Ford F-150 pickup truck when it collided with an 18-wheeler that had merged into the road at the intersection of La Avenida Iglesia. Gutierrez died at the scene. An unidentified passenger in the truck was last reported to be hospitalized with “major injuries.”
According to the preliminary DPS report, the driver of the Kenworth tractor trailer “failed to yield right of way” at the intersection. The commercial truck driver was not identified in the DPS report.
No charges had been filed as of this writing, but DPS investigation was continuing.

McAllen man killed in Donna area crash

A 50-year-old man died of injuries he sustained in an April 3 crash near Donna. This, according to a news release from the Texas Department of Public Safety (DPS).
The crash happened around 12:23 a.m. when a 2004 Buick Regal was travelling south on Dillon Road when it veered into the northbound lanes south of Alberta Road and collided with a 2004 Chevrolet Silverado. According to the DPS news release, the Buick veered into the wrong lane “for unknown reasons.”
The driver of the Buick, Agustin Arcos Garcia, was transported to DHR Health, where he died as a result of his injuries. There is no indication the other driver was injured.
The crash remained under investigation as of this publication.

NTSB: Failure to de-ice road preceded massive Texas crash

DALLAS — Federal officials say the company responsible for maintaining a Texas interstate where a massive chain-reaction pileup killed six people in 2021, failed to address the icy road conditions. The statement was released March 23, 2023 following a two-year NTSB investigation into the crash.
According to the report, the portion of Interstate 35 West in Fort Worth where the occurred was not treated with salt the morning of the Feb. 11, 2021 crash. The NTSB said that the failure of North Tarrant Express Mobility Partners Segment 3 to address the conditions contributed to the crash, as did drivers’ speeds.
The pileup involved a total of 130 vehicles, killed six people, and injured dozens more.
The NTSB said that the crash began when a vehicle struck the concrete barrier on the right side of the toll lanes. Other vehicles then began sliding, spinning and striking the barriers. Then a large truck crashed into some of those vehicles, and other vehicles that were unable to stop also became part of the massive crash that blocked all of the southbound toll lanes.
A spokesman for North Tarrant Express Mobility Partners Segment 3 did not immediately respond to a request for comment from the Associated Press. The Texas Department of Transportation also did not immediately respond to the news agency’s request for comment.

Edinburg police unit hit by alleged drunken driver

The Edinburg Police Department reports that one of its patrol cars was sideswiped by a suspected drunken driver. The incident happened March 17 at 4:00 a.m. in a Ford Escape who veered into the officer’s lane.
According to police, the incident occurred Friday around 4 a.m., but the location was not immediately clear. A news release states that an Edinburg police officer was on routine patrol when the driver of a Ford Escape veered into the officer’s lane and sideswiped his police cruiser near the right, rear bumper.
Neither the officer nor the other driver were hurt in the impact. The 51-year-old female driver (whose name was not released) reportedly provided a breath sample that showed she had a blood/alcohol content which was twice the legal limit.
“This is a vivid reminder to make a plan, and designate a sober driver, or use a ride-sharing service,” Edinburg Police Chief Jaime Ayala said in a news release. “We sign up for a dangerous job and we know the risks associated with that, but drinking and driving has serious consequences and lives cannot be replaced.”

Brownsville rollover crash leads to traffic delays

BROWNSVILLE — Brownsville police responded to a February 21 rollover crash involving one vehicle. According to Brownsville police, the crash which occurred in the southbound lanes of US 77 resulted in “no major injuries.” The mishap did, however, did lead to traffic delays as first responders worked to remove the vehicle and debris from the highway.
The driver of the vehicle was not immediately identified, and the cause of the accident had not been determined as of this writing. Likewise, there has been no indication that any citations will be issued as a result of the crash.
Preventing rollover accidents
Modern vehicles are designed to make it more difficult to rollover during a crash. However, a vehicle can still tumble if it is struck by another car or object in just the right manner. Nothing can prevent that.

One hospitalized following McAllen crash

McALLEN — McAllen police are investigating a February 21 two-vehicle accident.
The collision happened about 10:30 a.m. in the 1600 block of the I-69 westbound frontage road.
Only one minor injury was reported.

Woman critically injured in crash with Mercedes school bus

MERCEDES – An unidentified woman is in critical condition following a February 20 crash involving a Mercedes school bus, according to the Mercedes Police Department. The crash happened at approximately 8:25 a.m. in the 2400 block of North FM 491 Road.
According to police, the school bus was at a stop sign, signaling to turn into the bus entrance at Sgt. William G. Harrell Middle School, when it was rear ended by a black Chevrolet Cruze.
The vehicle, driven by an unidentified 45-year-old woman, became lodged halfway under the rear of the bus. It is still unknown what caused the driver to rear-end the bus, according to the news release.
Occupants on the bus, which included one student, did not sustain any injuries, according to the police department’s news release.

Alleged drunken driver accused of hitting police car

An Edinburg man is facing criminal charges that his vehicle collided with a police unit while he was driving under the influence of alcohol.
According to a news release, the crash happened February 5 at approximately 5:00 a.m. in the 6000 block of the I-69C freeway.
The release states that Edinburg police were at the location investigating a previous accident when a truck collided with a police unit that was parked on the inside lane of the highway. The truck was being driven by 52-year-old Edinburg resident Raul Alberto Rodriguez, who allegedly admitted to having been drinking, according to the release. Police say he also failed a field sobriety test.
Rodriguez was not seriously injured in the crash, and there were no officers inside the police car when it was struck. Rodriguez is charged with driving while intoxicated, and according to the release, records indicate he has a previous conviction for the same charge.
Who pays in a Texas drunk driving settlement?
Texas is an at-fault state. What that means is the driver who is at fault is liable for damages resulting from an accident. Since a drunken driver is per se at fault, it means that the drunken driver’s insurance carrier would have to pay for your damages.

Texas does not require bars that serve alcohol to carry insurance, but Texas law enables a victim to sue a bar that served alcohol to someone who clearly should not have been served.
