In the event of a tragic accident where you lose a loved one as the result of a trucking company’s negligence, it is in your best interest to seek legal representation to obtain the justice and financial recovery you and your surviving family members need to begin the healing process.
The McAllen truck accident attorneys of J.Gonzalez Injury Attorneys are here to explain what exactly counts as a wrongful death case and what damages can be secured through this type of claim.
Wrongful Death Cases Explained
Wrongful death, as per Section 71.001 of the Texas Civil Practice and Remedies Code, is the “wrongful act, neglect, carelessness, unskillfulness, or default” of a person taking the life of another. In order to establish a wrongful death claim against a company, the plaintiff must establish that the defendant was negligent in their actions.
A plaintiff or a plaintiff’s estate must be able to prove that a company owed the victim a “duty of care” and failed to do so, ultimately causing the fatality. Examples of a company’s negligence can include:
-
- The company failing to provide sufficient training to their employees/drivers.
- The company failing to give their driver enough time to rest or making them drive when they are incapable.
- Failing to fully inspect a company vehicle for faulty or defective parts that can lead to an accident.
Establishing a Wrongful Death Claim
When filing a wrongful death case, the following key points must be proven:
-
- The company acted in a negligent manner.
- The victim’s death was a direct result of the company’s negligent actions.
- The victim left behind surviving family members or beneficiaries/dependents, such as their spouse and children.
- The surviving family members or dependents suffered financial damages due to the death of the victim.
Who Is Eligible to File a Wrongful Death Case in Texas
According to Texas law, only the following individuals may be entitled to seek financial recovery in the event of a wrongful death:
-
- The surviving spouse
- Children (adults or minors)
- Legal parents/guardians
- A representative of the victim’s estate
It is crucial to note that the statute of limitations in Texas only allows you to file a wrongful death case within two years, starting from the date the incident occurred. However, in very rare instances, the statute of limitations may be extended if:
-
- The plaintiff filing the claim is a minor.
- The people accountable for the wrongful death had not been known.
- A physical or mental limitation kept the plaintiff from filing the lawsuit on time.
- Fraud has been detected.
Types of Damages Eligible to Recover in a Wrongful Death Claim
Our dedicated and compassionate McAllen truck accident attorneys will fight diligently to help you secure damages that include:
-
- Loss of earning capacity
- Medical bills and expenses
- Emotional and mental anguish
- Lost value of household services

- Cost of funeral and burial expenses
Additionally, in Texas, exemplary damages may be distributed if the death was considered to be willful or caused by gross negligence. These additional damages may be distributed to the beneficiaries for the sole purpose of making an example out of the defendant and their actions.

Man Dead After Rollover Accident In Donna
Posted on Friday, December 18th, 2020 at 7:32 pm
On the afternoon of Sunday, December 13th, a 26-year-old man was declared dead after a single-vehicle rollover accident in Donna.
Details of the Incident
According to local authorities, the accident occurred at approximately 1:20 pm on the 5400 block of Goolie Road in northwest Donna.
It is presumed that the 26-year-old driver was traveling north on Goolie Road at an excessive speed when he lost control of the vehicle, which resulted in the vehicle rolling over into a ditch.
The man was declared at the scene. It was reported that he was not wearing a seatbelt prior to the accident.
The incident is still under investigation, and no other passengers or drivers were involved.
Rollover Accidents Explained
Rollover accidents tend to be some of the most lethal types of accidents that occur on U.S. roadways.
There are two different types of rollover accidents, tripped and untripped:
- Tripped rollovers account for 95% of all rollover incidents and tend to occur when a driver accidentally “trips” over an object on the road, causing the vehicle to lose its balance and rollover.
- Untripped rollovers can occur for a variety of different factors such as untimed sharp turns, swerving, excessive speeding, lack of awareness, or dangerous driving situations as a result of bad weather, impaired driving, or road design.
The Importance of Wearing a Seat Belt
While car accidents are unpredictable by nature, the best defense to prevent injury or even death is to properly secure yourself (and all passengers) with a seatbelt. According to the Centers for Disease Control and Prevention, seat belts can help dramatically reduce the odds of car accident fatality by 45% and a personal injury by approximately 50%!
Additionally, out of 37,133 individuals killed in car crashes, 47% of them were reportedly unrestrained at the time of the incident, meaning those fatalities could’ve been prevented.
Not only are the consequences of not wearing a seat belt potentially life-threatening, but it can also cost you up to $200 for refusing to do so, as per Texas state law.

Stop Ambulance Chasing in Its Tracks: December is Anti-Barratry Awareness Month
Posted on Friday, December 18th, 2020 at 5:22 am
December is a lot more than a month-long holiday celebration. With festivities being a strong focal point during this time, drivers in between destinations will be at a higher risk of getting involved in catastrophic car accidents as a result of other distracted or drunk drivers.
While nobody ever wishes to be involved in a car accident of any kind, especially during the holiday season, it is important for you to willingly seek out and consult a personal injury attorney you trust, and not the other way around.
Unfortunately, there are far too many malicious attorneys that prey upon car accident victims following their car accident and try to take advantage of their power by seeking potential clients that did not consult them in the first place, which is a big no-no.
That’s why December is the perfect month to shine a light on this ongoing wrongdoing known as barratry, or ambulance chasing.
The McAllen car accident attorneys of J. Gonzalez Injury Attorneys would like to educate the community on why barratry is huge wrongdoing in the world of law and explain what to do if you or a loved one has encountered an attorney offering services you did not seek.
What Is Barratry?
Barratry is the illegal solicitation by an attorney–or on behalf of an attorney–for the sole purpose of seeking economic benefit shortly after a person was involved in an accident. According to the Texas Penal Code 38.12, the following can count as barratry after an accident if a person, attorney, or representative:
-
- Knowingly institutes a suit or claim that the person has not been authorized to pursue;
- Solicits employment, either in person, by phone, or virtually, for himself or another;
- Offers a form of payment or advances or promises a lump sum of money or anything of value either to prospective clients or their family members to get them to take their services;
- Accepts or agrees to accept money or anything of value to solicit employment.
Other forms of committing barratry include:
-
- An attorney or representative knowingly finances the commission of an offense under Subsection (a);
- Invests funds the person knows or believes are intended to further the commission of an offense under Subsection (a);
- Is a professional who knowingly accepts employment within the scope of the person’s license, registration, or certification that results from the solicitation of employment in violation of Subsection (a).
The only forms of solicitations that are not considered barratry are only if an attorney self-willingly offers their services pro-bono, meaning their services will be provided free of charge or if an attorney already has a pre-existing relationship with a client through a professional acquaintance or family relation.
The Problem With Barratry
When you are involved in a traumatic car accident, perhaps the last thing you need on your plate is for an attorney or a representative to constantly harass you to take their services while you are in a state of recovery.
When you report an accident to either the local authorities or medical professionals, uncertified individuals or agencies can grab ahold of your personal information and potentially sell it to law firms in an attempt to contact you and sell their services, which is a big invasion of privacy and extremely illegal.
While it is recommended to seek legal help after an accident, you are not necessarily forced to do so as it is a very personal decision that requires an adequate, in-depth look in regards to finding the right attorney that suits your needs well that will take on your case.
What to Do If You Experience Illegal Solicitation
In the event in which you are encountered by an attorney or a representative who is offering legal services that you did not ask for, it is crucial to take note of the following:
-
- The time, date, place, and/or form in which the encounter took place.
- Evidence such as business cards, digital phone logs, text messages, emails, or any other form of information or communication that indicates an illegal encounter took place.
- A grievance of the encounter filed on your behalf to either your local authorities or the State Bar of Texas.
The art of practicing personal injury law is founded upon and whole-heartedly embraces helping victims overcome devastating times, and barratry does the exact opposite. It is crucial that it is conducted in a non-intrusive and legal manner.
The McAllen car accident attorneys of J. Gonzalez Injury Attorneys take great pride in helping victims of personal injury the right way, and we don’t tolerate “opportunistic” attorneys and paralegals trying to hassle personal injury victims during times of suffering only for profit.
Our attorneys will work hard on your behalf to obtain the compensation you are entitled to, setting a positive example of how experienced attorneys should conduct themselves to victims seeking their help in a court of law.
If you or a loved one has been illegally solicited by an attorney immediately after a personal injury accident, do not hesitate to get in contact with J. Gonzalez Injury Attorneys.
Underaged Driver Crashes Into Tree, Leaves One Passenger Dead
Posted on Wednesday, December 16th, 2020 at 6:20 pm
On the night of Thursday, December 10th, a 15-year-old driver and a male passenger were involved in a serious single-vehicle accident after striking a tree, leaving the young driver with a broken leg and the male passenger dead in Houston.
Details About the Incident
According to local authorities, the accident occurred at approximately 11:15 p.m. on West Tidwell near Knox in Northwest Houston. The 15-year-old driver was traveling westbound on West Tidwell significantly above the speed limit before they lost control of the vehicle, going offroad and crashing into a tree.
Based on the leftover evidence, it is also presumed that speeding and intoxicated driving were the two pivotal factors that led to the deadly accident. The 20-year-old male passenger who was riding in the passenger seat was declared dead shortly after arriving at the hospital.
The driver suffered a broken leg and is currently being treated for her injuries. It is unconfirmed, however, whether or not the teenage driver was legally capable of operating the vehicle.
No charges have been filed thus far, and local authorities are still investigating the car accident.
The Numbers and Facts Behind Texas Teenage Car Accidents
Without the proper training needed, inexperienced teenage drivers can serve as a big problem to not only other drivers they are sharing the road with, but to themselves as well.
According to the American Automobile Association (AAA), it is three times more likely for a teenage driver to be involved in some sort of fatal car accident as opposed to experienced adult drivers.
Additionally, the Centers for Diseases Control and Prevention (CDC) reports that the risk of fatal vehicle accidents is significantly higher for those aged 16-19 in comparison to any other driving age group, with one of the major factors being excessive speeding.
In 2018, approximately 37% of all teenage driving fatalities occurred during the later hours, between 9 p.m. and 6 a.m., and 52% of these accidents occurred between Friday through Sunday.
It is important to note that under Texas state law, a teenager can apply for a provisional license which requires an adult inside the vehicle at the age of 16, and once the teenager has turned 18, they can apply for a standard adult license.
A Brief Look Into Single-Vehicle Accident Statistics
By nature, single-vehicle accidents tend to be one of the most lethal types of car accidents across U.S. roadways. They occur when a driver, for whatever reason, ultimately loses control of their vehicle, leading them to collide into a physically fixed object.
These types of accidents were solely responsible for approximately 53% of all traffic-related fatalities across the entire U.S. in 2018. As far as the state of Texas goes, there were a total number of 1,289 single-vehicle accident fatalities that same year, which accounted for approximately 35.42% of the state’s traffic fatalities alone.
Seeking Justice is Only One Consultation Away!
When a tragic car accident occurs at the hands of a reckless driver, it is in your best interest to seek the experienced legal representation you need as soon as you possibly can. The statutes of limitations in Texas for filing a car accident claim is two (2) years from the time the accident occurred, meaning that taking swift action is necessary in order to properly recover.

Hit-and-Run Accident In McAllen Ends Tragically
Posted on Friday, December 11th, 2020 at 6:16 pm
On the afternoon of Sunday, December 6th, an attempt to flee a hit-and-run accident turned into a disastrous rollover accident that left an 8-year-old dead and multiple individuals injured.
Details About the Incident
According to local authorities, the incident took place at approximately 1:30 p.m. on East Frontage Road near South Taylor Road in McAllen.
A 17-year-old male operating an SUV rear-ended a vehicle while traveling southbound on Ware Road. Rather than stopping to provide aid, the 17-year-old instead fled the scene and made his way toward Expressway 83.
While headed westbound on the expressway, the driver lost control of their vehicle and caused the SUV to rollover. All of the occupants were rushed to a nearby hospital, including 3 children and 1 other adult. An 8-year-old boy was declared dead at the hospital.
The 17-year-old driver did not suffer any significant injuries and was arrested shortly after the accident. He is currently awaiting charges.
The Catastrophic and Deadly Consequences of Rollover Accidents
Due to their impactful nature, rollover accidents tend to be one of the most catastrophic types, leaving the human body in shambles even if one survives.
Rollover accidents account for approximately 35% of all traffic-related fatalities across the United States, and 85% of these accidents tend to involve single vehicles.
The larger and narrower a vehicle tends to be, the more at risk they are at rolling over because of their relatively high center of gravity. While each rollover occurs because of very specific reasons, the majority of these accidents are known as “tripped” rollovers and occur when a vehicle loses its initial balance after tripping over a physical object on the road.
Other significant factors that can play a role in rollover accidents include but are not limited to:
- Untimed sharp turns.
- Uncontrolled swerving and/or maneuvers.
- Abnormal, impaired, and/or reckless driving behavior.
- Critical road conditions due to road design, lack of street signals and adequate lighting, or weather-related issues.
Crucial Notes to Take When Involved In a Hit-and-Run Accident
Hit-and-run accidents can occur at any given time as a result of a negligent and foolish driver attempting to get off the hook after causing a crash. In the event you are involved in a hit-and-run accident, it is vital to consider the following:
- Do NOT chase down the other vehicle: While we may feel a sense of anger, chasing down the negligent driver is not the solution. Instead, the wisest thing to do is to pull over away from traffic (but do not leave the scene), take a deep breath, and get in touch with the local authorities as soon as possible.
- Inform the authorities: While you may lack sufficient information, it is still important to notify the police and inform them of the incident that just occurred in order for them to start an investigation.
- Take as many notes as possible: It is crucial to write down as much detailed information as possible regarding the accident. Information to write down includes:
- The color and make of the vehicle.
- The direction the vehicle was going.
- When and where the accident took place, including the exact whereabouts and timing of the incident.
- The injuries you or any of your passengers sustained.
- Gather as much evidence as possible: Take as many photographs of the physical damages done to your vehicle, as well as any physical injuries you endured. It is also vital to take photos of the scene of the accident and any other photos that may seem relevant to your case

While we here at J. Gonzalez Injury Attorneys hope that everyone spends a pleasant Christmas and New Year’s Day, there are far too many tragedies that occur on U.S. roadways during the holiday season. Unfortunately, far too many festivities involve heavy alcohol consumption and some drivers may make the foolish mistake of getting behind the wheel while impaired.
The McAllen car accident lawyers of J. Gonzalez Injury Attorneys are here to shed light on some shocking holiday statistics and to share life-saving advice to keep in mind during the holiday season.
Holiday Impaired Driving Statistics You Should Know
Drunk driving during the holiday season is one of the biggest issues we face every year. According to the most recent data compiled by the U.S Department of Transportation, there is an annual average of 300 fatalities as a result of drunk driving incidents in the week between Christmas and New Year’s.
To add to these numbers, there is a daily average of 27 traffic-related fatalities during December as a direct result of impaired driving. As per Texas-state analytics, the most frequently noted time for drunk driving accidents is between 2:00 a.m. and 2:59 a.m.
Tips for Avoiding a Tragic Accident This Holiday Season
When you drive under-the-influence of alcohol or any other kind of substance, you are not only putting yourself at risk, but you are endangering the lives of all others on the road. In order to avoid a catastrophic car crash this holiday season, it would be wise to limit the amount of alcohol you enjoy while at a gathering – or even avoid touching it altogether.
If you do plan on consuming alcohol, it is wise to make arrangements with a friend and assign them to be your designated driver for the night, or consider using a rideshare service in order to avoid driving.
Additionally, make sure to drink plenty of water in between drinks and to drink alcoholic beverages slowly.

One Person Injured After Collision With Tractor
Posted on Tuesday, December 8th, 2020 at 5:12 pm
On the early morning of Thursday, December 3rd, a person was left with injuries after colliding with a farm tractor in Santa Rosa.
Details About the Incident
According to local authorities, the accident took place at approximately 7:30 a.m. on FM 2556, just south of Highway 107. A driver operating a Ford Mustang was attempting to bypass an opposing John Deer farm tractor that was in the process of making a left turn, and as a result, both vehicles collided into each other.
Following the incident, the driver of the Mustang was sent to the nearest hospital. No other injuries were reported, and the crash still remains under investigation.
Texas Car Accidents Statistics by the Numbers
While all drivers should practice good, responsible driving, there are times where some drivers make avoidable mistakes as a result of irresponsible, negligent, or even malicious decision-making, and this happens more often than you would expect.
To put this into perspective, in 2019, there was a vehicle-accident related fatality every 2 hours and 26 minutes, a traffic-related injury every 2 minutes and 3 seconds, and one crash reported every 56 seconds on Texas roadways. Additionally, there were a total number of 12,897 serious-vehicle accidents, in which approximately 15,843 people sustained serious injuries.
As far as Texas Farm-To-Market roads, it was reported that there were 121 traffic accidents per 100 million vehicle miles traveled.
What to Know About Tractor-Related Car Accidents
Tractor-related car accidents can not only cause serious property damage, but they can lead to serious, catastrophic injuries to the human body. Since farm tractors are relatively heavier vehicles in comparison to the standard road vehicle, they are often difficult to maneuver, which can lead to costly accidents due to slow reaction times.
In fact, an annual average of 50 tractor-driver lives are taken away as a result of colliding with opposing vehicles on the road, and even trains. Some of the most common factors that lead to tractor-related car accidents include:
-
- Faulty design
- Runovers
- Rollovers
- Entangled parts
- Driving error
- Collisions with opposing vehicles

A Shocking Overview On Auto-Pedestrian Accidents in Texas
When a person becomes a victim of an auto-pedestrian accident and survives, the consequences can be devastating to their mind, body, and cognitive well-being. In fact, these types of accidents tend to be one of the most lethal accidents for pedestrians traveling on U.S. roadways.
As per the most recent data compiled by the Texas Department of Transportation, there were a total of 5,952 pedestrian-related reported accidents in 2019. Out of these reported accidents, there were:
- 1,831 accidents in which 1,954 individuals suffered possible injuries.
- 1,991 accidents in which 2,095 individuals suffered non-incapacitating injuries.
- 1,215 accidents in which 1,260 individuals suffered serious injuries.
- 656 accidents that occurred, where 660 individuals lost their lives.
Potentially Life-Saving Advice for Pedestrians
While we all want to have a peaceful stroll or bike ride outside, it is vital to keep in mind the following tips in order to prevent a potentially fatal accident on our streets:
- Use Sidewalks When Possible: Sidewalks give pedestrians a medium to safely walk around. If no sidewalk is available, safely walk on the shoulder of the road against oncoming traffic or walk as far away from traffic as possible to avoid a dangerous accident with a driver.
- Utilize the Crosswalk: In order to get across the road in a safe manner, utilizing the crosswalk would be your safest bet. If no designated crosswalks are available, making direct eye contact with other drivers and signaling your intentions would be the best approach to crossing over to the other side of the road safely.
- Avoid Distractions: Pedestrians hold the same responsibility as drivers do in keeping your full, undivided attention to your surroundings on the road. With this being said, it is important to keep both your eyes and mind fully concentrated on the road to avoid any possible distractions that may lead to a costly accident.
- Make Yourself Visible: Making yourself visible to other drivers is the key to avoiding a disastrous accident. Wearing bright, reflective gear is best recommended when deciding to go out and about, especially during darker hours.
The compassionate Edinburg car accident attorney at J. Gonzalez Injury Attorneys will fight the negligent parties responsible for your tragedy in a civil court for the recovery you deserve.
