- Pays or gives or offers to pay or give a family member of a prospective client money or anything of value to solicit employment; or
- Accepts or agrees to accept money or anything of value to solicit employment.
Additionally, a person is found guilty of barratry if they:
- Knowingly finances the commission of an offense under Subsection (a);
- Invests funds the person knows or believes are intended to further the commission of an offense under Subsection (a); or
- Is a professional who knowingly accepts employment within the scope of the person’s license, registration, or certification that results from the solicitation of employment in violation of Subsection (a).
Barratry does NOT count, if, and only:
- if the attorney is not seeking any form of payment;
- already has a pre-existing relationship with the client, either professional or via family relation.
Consequences of Barratry
If a lawyer is found guilty of committing barratry, the initial offense is classified as a misdemeanor and comes with various fines. However, a repeat offender can eventually be charged with a third-degree felony.
Civil remedies for victims who have been fallen victim to barratry can include:
- $10,000 for every solicitation attempt they’ve experienced, either in person or through the phone.
- Eligible to collect the actual damages that were infringed upon, including attorney’s fees.

Toddler Struck In Tragic Accident

On the evening of December 5th, 2019, an unfortunate accident occurred in Harlingen as a 2-year-old boy was struck by his father’s pickup truck and was killed.
Details About The Incident
According to Harlingen PD via a press release, the fatal accident occurred just around 5:40 p.m. on the 100 block of West Wilson Avenue.
As per eyewitness reports, the father of the child was pulling out of the driveway in a 2010 Ford F-150, and in the process of it, the child stepped out of the house, got in the way of the vehicle as it exited the parking lot, and was tragically struck.
As more details are under investigation by local law enforcement, there are no criminal charges filed as of right now.

UTRGV Student Struck In Attempt To Cross The Street

On Wednesday, November 27th, a UTRGV student was taken to the hospital after being struck by a black vehicle while crossing the street.
Details About The Incident
According to Edinburg PD, the accident happened near the UTRGV campus on FM 107 and Sugar Road. The female student flipped into the air after she was struck by the black vehicle, later telling police that she suffered some back pain and was taken to the hospital for treatment shortly afterward.
An off-duty EMT happened to be on the scene and managed to help out the victim until the unit arrived to escort her to the hospital. The driver of the vehicle that struck the pedestrian claimed that she did not see the student cross the street.

Border Patrol Vehicle Collides Into School Bus

Seven children were injured in this bus crash accident that took place in La Joya.
Details Regarding the Accident
On Friday, November 22nd, a border patrol vehicle collided into a La Joya district school bus. The rear-end accident occurred around 7:00 a.m, with seven students from JFK Elementary in La Joya aboard the bus at the time of the accident.
The students and the bus driver were admitted to the hospital for check-ups after the crash, and the border patrol agent was also admitted to the hospital for the treatment of minor injuries.
The cause of the accident has not yet been determined and is still under investigation by local authorities.

Police Chase Ends in a Car Crash in San Manuel

The Department of Public Safety (DPS) is investigating a car crash that happened on Wednesday, November 6th, on U.S. 281 and F.M. 490 in San Manuel, TX.
Details Regarding the Accident
Hidalgo County authorities caught a green 2004 Ford Explorer carrying 5 individuals violating traffic law and attempted to stop them. The vehicle sped north on U.S. 281.
Then, in an effort to evade police, the green Explorer hit a turn-around and continued its escape southward. While traveling, the driver of the vehicle lost control and crashed into a tree.
One of the passengers was flown to Doctor’s Hospital at Renaissance, while the other four were rushed to local hospitals for treatment of major injuries.
The DPS is still investigating the crash.

Sullivan City Auto-Pedestrian Accident

On the morning of October 12th, at approximately 6:30 am, an auto-pedestrian accident occurred that left one victim dead near Sullivan City on the westbound lanes of Expressway 83 north of FM 886.
Details About the Incident
The pedestrian was with a group of other unspecified individuals that were on the southbound side of the expressway and were attempting to cross over into the northbound side when the victim got struck by a black truck.
The driver of the vehicle immediately notified the police of the accident, but as soon as authorities tried to reach out for medical assistance, the victim was deceased.
The whereabouts of the other individuals are unknown at this time.
