4-Vehicle Crash Leaves 7 Injured In Austin

Posted on Monday, April 12th, 2021 at 7:25 pm

On the morning of Saturday, April 10th, a four-vehicle crash occurred that injured seven individuals in North Austin.

Details About the Accident

According to Austin-Travis County EMS, the accident occurred at approximately 11:00 a.m. at the intersection of North Lamar Boulevard and West Parmer Lane.

While details still remain vague to how the accident happened, it was reported that the EMS team had to rescue a trapped individual, one of the seven injured–out of their vehicle.

The person was successfully freed and rushed to the nearest hospital where they are being treated for potentially serious injuries. A trauma alert was established for a child that was involved, who was rushed to a separate hospital after the accident occurred.

Two other individuals were taken to the hospital where they received medical evaluations respectively. No arrest or fatalities have been confirmed at this time, and the incident is still under investigation.

The Danger Behind Multi-Vehicle Accidents

Multi-vehicle accidents can be catastrophic types of car accidents that can happen for a variety of reasons. Some of the most common incidents tend to happen because of distracted driving-related factors, fatigued or intoxicated driving, speeding, or, in rare instances, vehicle malfunctions.

Needless to say, if you are to avoid these types of car accidents, you must do your part in driving safely:

    1. Don’t drink and drive; get a designated driver or hire a rideshare service.
    2. Get enough rest before driving for long periods of time.
    3. If you’re sick, rest until you are well before going out on the road.
    4. Leave the cell phone off. Texting and driving is one of the biggest reasons car accidents happen.
    5. Make sure you take your car in for maintenance frequently–as per your manuals recommendations. Also be on the lookout if your car manufacturer issued out any recall notices.

It was reported by the Insurance Institute for Highway Safety (IIHS) that in 2019, there were 16,839 fatalities due to these types of events, which accounted for 47% of the entire death rate in the U.S.

Additionally, the state of Texas recorded 1,827 of those national fatalities and accounted for 51% of the state’s traffic fatalities in 2019.

Who Is Liable When an Emergency Vehicle Is In an Accident?

Posted on Thursday, April 8th, 2021 at 8:44 pm

When you’re on the road and you hear an emergency vehicle siren blaring, your first instinct is to move out of the way to avoid delays for the emergency responders and, of course, to prevent an accident. Not to mention, it’s the law.

But what happens when an emergency vehicle is involved in an accident?

When high speeds are involved, there are increased risks for accidents to occur, and in instances where a passenger vehicle is involved in an accident with an emergency vehicle, determining liability may become a bit complicated.

In these types of complex cases, a skilled and experienced car accident attorney will help you through the claims process.

How Common Are Accidents Involving Emergency Vehicles?

Because many accidents involving emergency vehicles are not widely reported by the media, it’s easy to assume these types of accidents or collisions are not common. However, the National Safety Council (NSC) reports that accidents involving emergency vehicles are more common than one might realize.

In 2018, 168 people were fatally injured in accidents involving emergency vehicles, with over half of the victims reported as occupants of passenger vehicles. Police cars were involved in the highest number of fatalities, followed by ambulances, then fire trucks.

In cases of accidents involving emergency vehicles, many may not always be reported, unless the accident involves serious injuries or fatalities.

Who Is At Fault In These Type of Vehicle Accidents?

Emergency vehicles are generally the property of a municipal, county, or federal agency; as a result, defining a liable party can become complicated.

Governments have protection from lawsuits based on a concept known as “immunity,” which restricts one’s ability to hold them legally accountable in the same manner you could hold others. This may occur even in cases involving personal injury.

Take, for example, a car accident with another person. In cases like this, a person may sue a number of parties including another person, an insurance company, or the company or business responsible for damages sustained.

In these types of lawsuits, a person may collect medical expenses, loss of wages, property damages, and other losses associated with the accident.

However, in cases involving police, ambulances, fire trucks, mail trucks, or municipal vehicles, an accident victim may end up stuck with the bill, even through no fault of their own.

Filing a Claim In Emergency Vehicle Accidents

The government is well protected from liability, but exceptions exist that allow for individuals to move forward with a lawsuit in cases of accident or collision with emergency vehicles and their employees. An administrative claim will be the first step when making a claim against a governmental body.

This requires immediate action, as most government agencies offer only a small window of time to file a claim against them. Claims may be denied if a person does not comply with this shortened deadline.

Filing a claim requires a fair settlement figure that will cover the costs of damages accrued. This process may be complicated, and in the event a claim is denied, a person may have the option to sue. These types of lawsuits are more complex than regular lawsuits, and the assistance of a well-respected and qualified personal injury attorney will be critical to the outcome of your case.

J. Gonzalez Injury Attorneys Delivers Results

Accident victims often face an uphill battle when it comes to securing fair compensation for losses, damages, and injuries sustained in an accident with another passenger vehicle. When the accident involves an emergency vehicle, the process becomes even more complicated.

A skilled lawyer with experience in these types of cases is important for a favorable outcome. Helping accident victims across South Texas and the Rio Grande Valley, J. Gonzalez Injury Attorneys can help you get back on your feet and secure the compensation you deserve for your pain and suffering.

Late-Night Rollover Sends Person to Hospital Via Airlift in Austin

Posted on Sunday, March 28th, 2021 at 12:39 am

On the early morning of Wednesday, March 24th, a rollover accident left a person with critical, life-threatening injuries near the North Travis County area.

Details About the Car Accident

According to local authorities, the rollover accident occurred at around 2:54 a.m. on the intersection of East Wells Branch Parkway and Dessau Road. The victim was reportedly ejected from their vehicle and pinned underneath after rolling over.

The Austin Travis-County EMS responded to the accident shortly afterward and were able to free the patient. However, the patient was unconscious, and a trauma alert was declared.

The patient was airlifted to the nearest hospital, and the intersection remained closed until further notice.

The Majority of Rollovers are Single-Vehicle Accidents

This unfortunate accident was considered a single-vehicle accident. The National Highway Traffic Safety Administration (NHTSA) states that around 85% of rollover accidents only involve one vehicle, and the latest data provided by the Insurance Institute for Highway Safety (IIHS) states that a total number of 19,257 fatal single-vehicle accidents had occurred across the U.S. in 2019.

Keep in mind, this doesn’t necessarily paint an accurate portrait of just how many rollover accidents occur in a year. One thing’s for certain, however, that single-vehicle accidents were responsible for approximately 53% of all fatal road accidents across the U.S. In Texas, a total number of 1,788 single-vehicle fatalities were recorded as well, accounting for approximately 49% of the state’s fatal car accidents that same year.

3 Children, Mother Declared Dead After 7-Vehicle Crash In Harris County

Posted on Thursday, March 18th, 2021 at 6:15 pm

On March 14th, a 28-year-old mother and 3 of her children died when an intoxicated driver caused a 7-vehicle accident near Houston.

Details About the Car Accident

According to the Harris County Sheriff’s Office, the accident occurred around 8:30 p.m. on FM 2920, near Gosling Road, in Harris County.

The 35-year-old intoxicated driver, who was pulled over by Harris County Deputies 20 minutes prior to the accident, was allegedly driving under the influence of alcohol with a blood alcohol content level of .15, which is nearly double the amount that the State of Texas recognizes as “drunk”.

The defendant struck the mother’s vehicle from behind on Gosling Road, which caused a chain-reaction crash that involved other vehicles. The victim’s vehicle was caught on fire as a result of the accident and killed her 7-month old child and herself on sight.

Two of her children–a 5-year old and a 2-year-old–were rushed to the hospital. They were eventually declared dead.

The 35-year-old male was arrested on 3 counts of intoxicated manslaughter and 1 count of intoxication assault.

No other injuries or fatalities were reported from other vehicles involved.

Harris County’s Staggering Intoxicated Driving Problem

Harris County has been considered to be the epicenter for drunk driving accidents and fatalities in the United States. In fact, this area has led the nation in DWI-related fatalities every single year for the past 18 years.

In 2019, Harris County experienced a total number of 3,603 DUI-related accidents across the entire county.

Out of these reported accidents, the following incidents were reported:

    • 642 DUI-incidents in which 1,077 individuals suffered possible injuries.
    • 424 DUI-incidents in which 616 individuals suffered non-incapacitating injuries.
    • 184 DUI-incidents in which 235 individuals suffered serious injuries.
    • 110 fatal DUI-incidents in which 120 individuals lost their lives because of a drunk driver.

If found guilty of a drunk-driving offense in Harris County–or anywhere in the State of Texas–jail time, hefty fines, and license suspension could be issued out as a consequence.

When convicted of a DUI, the following penalties can come into action:

    • 180 days worth of jail time and/or $2,000 maximum fine. In addition, a 90-day license suspension on a FIRST offense may also be placed onto the offender.
    • For the SECOND offense: up to 365 days of jail time and/or $4,000 maximum fine, with a possibility of at least a one-year license suspension and an annual fee of up to $2,000 for a three-year period to keep your license (if committed within 5 years from the first one).
    • For the THIRD offense: 2-10 years in prison and/or $10,000 fine, with a one to two-year license suspension and an annual fee of up to $2,000 for a three-year period to keep your license (also within 5 years from the last offense).
