Bexar County Accident Leaves Two Hospitalized
Posted on Wednesday, July 14th, 2021 at 5:53 pm
Two people were hospitalized after a rollover crash that took place on the morning of Monday, June 12th, in Bexar County.
Details About the Incident
San Antonio police were called to the 13600 block of U.S. Highway 281 North around 3 a.m. after a Hyundai Sonata drove off the highway and flipped over.
The 17-year-old driver and passenger were hospitalized following the rollover crash.
Police report that the occupants were traveling south on Highway 281 when they drove off the freeway for unknown reasons.
According to SAPD, the vehicle was north of the Bitters Road overpass when the driver drove through the median between the highway and the access road. Police believe that is when the sedan drove off the edge of an embankment on the north side of Bitters Road and rolled over.
Both occupants had their seatbelts fastened at the time of the incident and were taken to a nearby hospital in stable condition.
Fatalities Caused by Single-Vehicle Accidents Rose from 2019 to 2020
Incidents like this are considered single-vehicle accidents. Fortunately, for the motorists involved, no lives were lost — but that isn’t always the case.
According to the Texas Department of Transportation, 205,498 persons were injured in motor vehicle traffic crashes in 2020.
Furthermore, single vehicle, run-off the road crashes resulted in 1,354 deaths in 2020. This figure represents an approximate 15% increase from the 1,172 deaths experienced on Texas roads in 2019.
What Causes Rollover Accidents?
Driver error is a significant factor in rollover accidents, according to the National Highway and Traffic Safety Administration. Other factors such as weather conditions can contribute to rollovers, but the majority of crashes are due to drivers overcompensating in emergency situations.
Factors that increase the odds of a rollover accident include:
-
- Speeding: More often than not, excessive speeding is one of the main factors in fatal rollovers.
- Driving While Impaired: Driving while impaired disrupts a driver’s judgment and coordination. Almost half of all fatal rollovers involve a drunk driver.
- Distracted Driving: Distracted drivers tend to make sudden/sharp maneuvers, which greatly increases their chances of rolling over.
- Tall/Narrow Vehicles: Some vehicle types such as SUVs, pickups, and vans are more susceptible to rollover accidents than traditional sedans and compact cars due to their high center of gravity.
- Country Roads: Country highways and rural roads tend to experience more rollover fatalities since they often lack the safety features available on more-frequented roadways.
- Tire Failure: According to the National Highway Traffic Safety Administration (NHTSA), defective tires can lessen your ability to control a car and may result in single-vehicle crashes. Tire blowout and loss of tire tread are two of the most common causes of tire failure.
Despite driver error being a significant factor in rollover accidents, it’s clear that many of the other contributing factors can be avoided by following the rules of the road and understanding how your vehicle operates.

What You Should Include in Your Car Emergency Kit
Posted on Tuesday, July 13th, 2021 at 5:00 pm
Summer is here, and families from all over the Rio Grande Valley are taking the opportunity to once again travel this great big state. Of course this year, more Texans are likely to hit the interstates and highways because of last year’s missed summer.
Because of all these extra cars on the road, you’ll want to be prepared for any emergency situations – whether it’s being involved in a car accident or finding yourself in an unexpected situation.
Your McAllen car accident lawyers at J. Gonzalez Injury Attorneys have our community’s health and safety in mind. That’s why our experienced attorneys have put together a guide for creating your roadside emergency kit. This kit can prove to be a true lifesaver if you should find yourself in an unforeseen emergency while out on the road.
What is a Car Emergency Kit?
An emergency roadside kit is exactly what it sounds like: a set of tools, resources, and supplies that can help to keep you and your family safe should you find yourself in an unexpected situation. Whether you decide to purchase a pre-made kit or create your very own customized roadside kit, this resource can be just what you need to get yourself out of a number of sticky circumstances.
While you may not realize it, your car could turn into a sanctuary, particularly in low population areas where you may be miles away from the nearest town. Whether you suffer a flat tire, a blown engine, or find yourself trying to escape a severe summer storm, an emergency car kit can be essential to saving your life.
Determining What to Put In Your Emergency Roadside Kit
Determining the supplies you need will depend on a number of factors. Take into consideration the following questions to help you get a better idea of what you need for your road trip:
- How many people will be traveling with you?
- Will you be traveling with infants or young children?
- Will you be traveling with older adults who may need more rest stops?
- How long will you be traveling?
- What time of day will you be traveling?
- Are you taking pets?
- What will the weather be like at your starting point, on the road, and at your destination?
- Have you recently serviced your vehicle?
What Do I Include In My Roadside Emergency Kit?
Automotive Supplies
- Jumper cables
- Oil
- Antifreeze
- Transmission fluid
- Empty gas can
- Tools (e.g. a wheel wrench and jack)
- Flashlight
- Batteries
- Spare tire
- Fix-a-Flat
Weather Supplies
- Extra wiper fluid
- Ice scraper
- Shovel
- Kitty litter for traction (on snowy or frozen roads)
- Extra gloves
- Rain ponchos
- Sunscreen
First Aid Supplies
- Hand sanitizer
- Bandages and band-aids
- Gauze
- Antibiotic ointment
- Pain relievers
- Wipes
- Prescriptions
Supplies for Children
- Baby wipes
- Extra bottles
- Extra diapers
Additional Supplies
- Snacks
- Toilet paper and tissues
- Food and water bowls for pets
- Toys and blankets
- Map
- Extra cell phone chargers
- Bottled water
Before You Hit the Road
If you’re taking a major road trip and haven’t provided maintenance to your vehicle in some time, you’ll want to take it into your local mechanic for an oil change, to top off your car’s fluids, and just to ensure that it can handle the trip.
You will also want to check your tires for tread and air pressure. An easy way to make sure you have a safe amount of tread on your tires is to stick a penny upside down inside one of the grooves. If Lincoln’s head is still showing, then it’s time for new tires. Ensuring that your tires are at the proper amount of air pressure will not only help to reduce the risk of a flat tire, it will also help you get greater fuel efficiency on your trip.

The Dangers of Hydroplaning & How to Protect Yourself
Posted on Monday, July 12th, 2021 at 6:31 pm
Since the end of May, we’ve seen quite a few days of heavy rains in the Rio Grande Valley, including June 2nd and 4th, which saw a combined 7-inches of rain at the McAllen Miller International Airport Station.
During the week of July 4th, the Prediction Center of the National Weather Service issued a high risk for flash flooding for various portions of the Valley – and for good reason. Regions of Cameron County saw in excess of 7-inches of rainfall over the course of a few days. In the Upper Valley, McAllen saw more than 4 ½ inches alone on Wednesday, July 7th, while other areas of Hidalgo County received as much as 9 inches.
Concerningly, South Texas has yet to experience its first tropical storm or hurricane for the year, which would bring many more concerns and issues – including problems for drivers. Unfortunately, while most drivers know they should slow down in heavy rains, the sad truth is that many fail to do so, becoming dangers to themselves and others.
One of the major causes of concern when driving in the rain is hydroplaning. Our McAllen car accident attorneys have helped secure damages and justice for many clients who have been injured as the result of a hydroplaning accident, and we want you to be aware of the dangers of such an accident.
What Is Hydroplaning?
In light rain, suitable tires can maintain contact and traction on the road’s surface. However, when a vehicle travels over substantial amounts of rain, a film can build up underneath the tire, causing it to lose contact with the road. When this happens, a driver can lose control of their vehicle in what is known as hydroplaning.
Hydroplaning can affect all types of vehicles, including cars, trucks, motorcycles, or semi-trucks, rendering them essentially impossible to control. Unsurprisingly, this loss of control can easily lead to vehicles slamming into oncoming traffic or spinning around and colliding with other drivers, road signs, trees, or other road structures.
Note that hydroplaning is more likely to occur in the first few minutes of a rainstorm when the water begins to mix with oil on the road, rendering surfaces slick.
Vehicles traveling faster than 35 mph are also at an increased #risk of #hydroplaning via @TopLawyerRGV #CarAccident #Lawyer
How to Avoid Hydroplaning
To avoid hydroplaning and losing control of your vehicle, there are a number of steps you can take to minimize risks:
-
- Drive slowly in bad weather conditions
- Turn off cruise control
- Drive in a lower gear
- Avoid sharp turns
- Avoid suddenly braking
Additionally, there are several best practices and vehicle maintenance tips that can also lower your chances of hydroplaning:
-
- Driving in the tire tracks of the vehicle in front of you
- Adhere to regular tune-ups and maintenance
- Check your tires frequently, searching for damages, punctures, or under/over inflation
- Rotate or replace your tires as necessary
What to Do If You Begin Hydroplaning
There are a number of steps that you should take in case your car begins to hydroplane:
-
- One of the best measures to prevent hydroplaning is to drive in the center of the road. The sides of the roads are generally lower and allow for standing water to form.
- Should you begin hydroplaning, avoid braking as this can cause you to skid even harder and lose control.
- Stay calm, ease off the gas, and begin to gently steer into the skid. This maneuver can help you regain traction.
- When you regain some traction, some light counter-steering can help you correct the car.
- Should you need to use your brakes to avoid hitting another car, gently pump them until you have regained traction.
Many conditions can lead up to a hydroplaning car accident. If a negligent driver is speeding during a rainstorm, they could begin hydroplaning, striking any cars or trucks nearby. At the same time, if a road maintenance agency failed to keep the road in good condition that led to it pooling water, they too could be held liable for any injury.
It isn’t easy to collect damages from a hydroplaning car accident, but with the help of an experienced McAllen car accident lawyer, like the ones at J. Gonzalez Injury Attorneys, you stand a great chance.

- Approximately one-third of all traffic crash fatalities in the U.S. involve drunk drivers.
About Wrongful Death Claims
A wrongful death occurs when a person’s negligence or intentional actions cause the death of someone else. After a wrongful death incident, specific surviving members of the family have the option of seeking restitution through a civil lawsuit. Please note that a civil lawsuit can still be brought against the defendant even if they are acquitted in a criminal case.
In order to file a wrongful death claim, the following criteria must be met:
- A death of a human was caused by intentional harm or negligence.
- The surviving family members are left financially distraught because of the death.
- A representative of the decedent’s estate was appointed and is filing a claim on behalf of any surviving beneficiaries.
In the state of #Texas, as per Texas Statutes section 16.003, the statute of limitations for filing a wrongful death is two (2) years from the date of the fatality via @TopLawyerRGV #CarAccidentLawyer

The Most Dangerous Roads in Rio Grande Valley
Posted on Monday, July 5th, 2021 at 2:59 pm
Operating a vehicle on any road requires due diligence and defensive driving skills. However, there are certain roads in Texas that require extra caution and care. Today, the McAllen car accident attorney and Top Lawyer, J. Gonzalez of J. Gonzalez Injury Attorneys, is going to bring to light which roads in the RGV are the most dangerous so that you can take adequate safety precautions while traveling on them.
You don’t have to suffer in silence. If you’ve been injured in a car accident because of another negligent driver on any of these busy roadways, contact J. Gonzalez Injury Attorneys now!
Identifying the Most Dangerous Roadways in the RGV
The most common factor with all of these roadways is that they are busy–and oftentimes congested–roadways. The key takeaway here is that the more people that drive on a particular roadway, the risk of getting into a car accident is increased.
This doesn’t mean you should avoid traveling on these roadways, however. As always, practice safe driving techniques like:
- Minimizing all distractions (no cell phone use, etc.).
- Maintaining safe distances from vehicles in front of and behind you.
- Being aware of and looking out for your blind spots.
- Slowing down at intersections.
- Looking beyond the vehicles in front of you to anticipate any abrupt changes in travel.
- Don’t drink (or use illegal/prescription drugs) and drive. Always have a designated, sober driver.
U.S. Highway 83
In the Rio Grande Valley, the most dangerous roadway is U.S. Highway 83. It stretches east-to-west throughout the Rio Grande Valley from Starr County to Cameron County. The expressway runs through the McAllen metro area and then continues east to Donna and Mercedes before connecting with IH-69E and U.S. 77 in Harlingen, and it is the main roadway locals and tourists use to get from city to city in the RGV.
Interstate 69C & U.S. 281
Interstate 69C connects the Rio Grande Valley to its northern county neighbors, running through Edinburg, McAllen, and Pharr. This roadway funnels locals and tourists into and out of the Rio Grande Valley, and because of our proximity to Mexico, many large trucks delivering international goods for trade also pass through here.
Interstate 69E/U.S. 77
Running parallel to Interstate 69C, U.S. 77 runs north near Raymondville and stretches down into Harlingen, where it connects with Interstate 2 and continues southeast towards San Benito, Brownsville, and the Mexico border.
This roadway is also another funnel for traffic–both national and international–into the RGV.
International Boulevard/Boca Chica Boulevard (Brownsville)
International Boulevard/Boca Chica Blvd. extended east 24.4 miles, running from the central business district of Brownsville to Boca Chica State Park on the Gulf Coast. This is easily one of Brownsville’s busiest roadways with an even busier intersection, so practice caution when driving through it.
TX-186
State Highway 186 runs east from Interstate 69C through northern areas of Hidalgo and Cameron County, going through Raymondville and ending at the Gulf Coast. It is one of the main ways to get to Port Mansfield, where many go to visit, fish, or relax. The way there, however, has many twists and turns, and it also runs through deer territory, posing more of a danger to unaware drivers.
Texas 100
Undoubtedly one of the most dangerous streets in the Rio Grande Valley because of drunk drivers and substantial amounts of travelers, SH 100 runs east from Interstate 69E through Los Fresnos extending to Port Isabel and crossing into South Padre Island via the Queen Isabella Causeway.
This is the main way that funnels into South Padre Island, and around Spring Break, holidays, and even on weekends, it can become a dangerous place to drive in if you aren’t careful.
Texas 107
Another main thoroughfare in the Rio Grande Valley, Texas 107 stretches from Mission to Edinburg and on into Combes in Cameron County. This road is a direct link to the University of Texas Rio Grande Valley and the Hidalgo County Courthouse, so traffic is always congested in these areas.
10th Street
10th Street, or State Highway 336, links Hidalgo with McAllen and travels northward into Edinburg. One of the major arteries in Hidalgo County, 10th Street is a critical street overflowing with local businesses and traffic. It is an important part of the heart of trade in McAllen, TX.
2020 RGV Car Accident Statistics
These statistics paint an accurate picture of how many car accidents happen in the Rio Grande Valley. Don’t become another statistic. Practice your defensive driving skills at all times, even if it is just a quick trip.
- In 2020, more than 24,000 car accidents occurred in the Rio Grande Valley involving over 47,000 vehicles and nearly 65,000 individuals.
- Out of the 62,972 persons involved in car accidents in the Rio Grande Valley that same year
-
- 15,011 suffered a suspected injury
- 3,834 suffered a minor injury
- 973 suffered serious injury
- 179 lost their lives
- Hidalgo County saw a total of 15,782 car accidents.
- Cameron County saw a total of 7,568 accidents.
- Starr County saw a total of 733 accidents.
- Willacy County had a total of 251 accidents.
If You’ve Been Injured in a Car Accident in the RGV Recently, There is Hope.
Car accidents are a traumatic event to endure, but you don’t have to do it alone. If a negligent individual caused your car accident, you can fight for your right to compensation for the expenses you have had to pay while recovering.
That’s why you need an experienced McAllen car accident attorney by your side when you file a car accident claim. Our Top Lawyer, J. Gonzalez, has the dedication and experience you need to get the compensation you deserve.
Driver Involved in Two Crashes Loses Life in Mission
Posted on Saturday, July 3rd, 2021 at 6:49 pm
A male driver died early Saturday, June 3, after causing two different accidents in Mission and Palmview.
Details About the Mission Car Accident
According to the Palmview Police Department, the driver of a Dodge Charger was initially involved in a crash in MIssion near 3 Mile Road and Breyfogle Road. The driver fled the scene of the crash before striking a Hidalgo County Precinct 3 deputy constable’s vehicle at the intersection of 495 and Breyfogle Road.
The deputy constable involved in the accident was hospitalized in stable condition, while the driver of the Charger was pronounced dead at the scene.
The Palmview Police Chief mentioned that alcohol may have been a factor in the crashes. The Mission Police Dept. is investigating the first crash, while the Texas Dept. of Public Safety and Palmview Police investigate the second.
Texas DPS Troopers Urge Drivers Not to Drink & Driving During 4th of July
State, county, and city officials throughout the Rio Grande Valley are urging drivers not to drink and drive.
The Texas Dept. of Public Safety will be sending more troopers to protect the roads this holiday weekend. While numbers were down in 2020 because of the pandemic, an extra measure of concern is taking place this year as the state has opened up.
Troopers won’t just be on the lookout for suspected drunk drivers either. Officers will be on the lookout for individuals speeding, driving without safety belts, and engaging in other illegal behaviors.
Data from last year’s Fourth of July shows that approximately 16,000 individuals were cited for speeding.
Drunk Driving Laws in Texas
The Texas Department of Transportation states that someone is hurt or killed every 20 minutes in an accident involving alcohol. EVERY 20 MINUTES someone loses a loved one. Someone’s life changes forever.
In Texas:
- A person who is legally intoxicated can be arrested and charged with Driving While Intoxicated (DWI) if their blood or breath alcohol concentration is at .08 or higher.
- It is illegal for anyone under 21 to have any trace of alcohol in his/her system.
- Commercial drivers may not have more than a .04 BAC.
Individuals who have suffered a personal injury as the result of a drunk driving accident should know that the drunk driver is NOT necessarily the sole responsible party for the accident. In Texas, Dram Shop Liability laws can help you to hold liquor-serving establishments partially liable for their role in the accident.
If you’re injured in an accident this 4th of July, do not hesitate to contact the McAllen car accidents lawyers of J. Gonzalez Injury Attorneys immediately.

Pedestrian Killed In Rural Edinburg
Posted on Tuesday, June 22nd, 2021 at 7:25 pm
An early morning accident in Edinburg on Monday, June 14th, cost the life of a pedestrian.
What’s Known About the Accident
According to Texas DPS troopers, the incident took place just before 1 a.m. on Monday, June 14th in a rural area northeast of Edinburg.
The driver of a Ford Explorer was traveling north on Alamo Road when a pedestrian unexpectedly walked onto the road south of Davis road. The pedestrian was struck and pronounced dead at the scene of the accident.
The driver was not injured in the accident.
Main Causes of Pedestrian Accidents
Pedestrian traffic accidents can happen under various circumstances – and at times – are caused by lack of attention or inappropriate actions by the pedestrians themselves.
Generally speaking, however, accidents are often caused by negligence. The negligent behavior of the driver (or pedestrian) can easily lead to a serious injury or fatality.
Some of the main causes of pedestrian accidents include:
-
- Alcohol: One of the leading causes of car accidents in general, driving while under the influence of alcohol (or drugs) can quickly lead to a pedestrian auto accident. It’s also worth noting that many alcohol-related accidents involve pedestrians who are intoxicated.
- Failure to stop at crosswalks: Many drivers simply fail to follow traffic laws. This can mean failing to stop at a stop sign or traffic light that also has a crosswalk.
- Road rage and uncontrolled speed: Another leading cause of car accidents in general, aggressive driving coupled with excessive speed has been shown to be a huge factor in fatal accidents. Road rage often leads to reckless driving behavior and failure to obey traffic signs and laws, which can leave pedestrians without a chance in sight.
- Distracted driving: Happening much more frequently because of today’s “cell phone culture,” distracted driving is another form of negligent driving that can quickly lead to a tragedy. Of course, while texting and unnecessary cell phone use do contribute to auto-pedestrian accidents, other behaviors such as changing the radio station, eating, searching for items on the floor, or adjusting one’s appearance in the mirror can all lead to a fatality.
What happens if I’ve been in an auto-pedestrian accident?
If you or a loved one was a victim of an auto-pedestrian accident (and you were the pedestrian), there are remedies and legal actions that you can take to recover damages. Our McAllen car accident lawyers at J. Gonzalez Injury Attorneys can help you bring the negligent driver to justice.

Suspected Drunk Driver Rear-Ends Police Vehicle in San Antonio
Posted on Tuesday, June 22nd, 2021 at 4:35 pm
On Saturday, June 19th, a suspected drunk driver rear-ended a police vehicle on the highway at approximately 11 p.m.
Details About the Car Crash
According to San Antonio police, the driver of a pickup truck rear-ended a police lieutenant who was driving on Highway 281 to Loop 410 eastbound ramp.
The lieutenant was checked by EMS but thankfully did not suffer any critical injuries.
The driver of the pickup was given a field sobriety test and was taken into custody for a DWI.
Most Common Rear-End Accident Injuries
1. Whiplash
The most common type of injury reported after rear-end collisions is whiplash. Whiplash is caused by a sudden movement of the neck and head, and generally results in weeks, or even a year, of soreness.
2. Airbag Injuries
Airbags can cause burns on the hands, face, or scalp, and the force of an airbag deploying can lead to broken bones, including the nose or ribs.
3. Seat Belt Injuries
When a vehicle is hit in a rear-end collision, your seat belt immediately tightens. Unfortunately, the seat belt can cut or severely bruise you when it suddenly restricts movement.
4. Back Injuries
During a rear-end accident, the force of the collision can cause serious back injuries, including compression of the spine or compression of the discs in the lower spinal column.
5. Head and Brain Injuries
These types of injuries can include concussions, lacerations, swelling, loss of consciousness, bruising, and traumatic brain injuries.
6. Wrist and Arm Injuries
The person most likely to suffer wrist and hand injuries during a rear-end collision is the driver. This is due to the fact that the driver most likely has their hands on the steering wheel.
Compensation You Can Receive for a Rear-End Collision
The at-fault driver’s insurance company should cover any damages to your vehicle and any costs associated with medical care to treat your injuries. Our McAllen car accident lawyers at J. Gonzalez Injury Attorneys will fight with everything we have to help you secure compensation for but not limited to:
- Medical expenses (past and future)
- Property damages
- Lost wages
- Pain and suffering
- Wrongful death

- The vehicle you are attempting to pass is already traveling at the speed limit or speeds up as you attempt to pass.
- You are passing a vehicle on grades.
- You are attempting to pass a school bus that is loading or unloading children.
