Man Turns Himself Into Police After Hit-and-Run Leaves Two Dead

Posted on Wednesday, August 11th, 2021 at 7:04 pm

A hit-and-run auto-pedestrian accident that took place on August 1 left two dead in Edinburg and a man on the run.

Details About the Hit-and-Run Accident

On the night of Sunday, August 1, the Texas Department of Public Safety began investigating an auto-pedestrian accident that took place on N. Alamo Road, south of 17 ½ road in Edinburg. Two women were reportedly pumping gas into their vehicle on the side of the road when a pickup truck traveling south struck the victims.

At the time, the driver of the pickup drove away.

The victims were transported to local hospitals. One of the victims was a pregnant 18-year-old who lost her life at the hospital. While doctors attempted to save the unborn child she was carrying, they were unsuccessful.

On Tuesday, August 3, the driver of the hit-and-run turned himself in to authorities.

The individual was charged with failure to stop and render aid, failure to render aid with serious bodily injuries, and tampering with physical evidence.

Auto-Pedestrian Statistics

Sadly, in recent years, the number of pedestrian fatalities in the United States has grown exponentially. Between 2009 to 2018, the number of pedestrian fatalities increased by 53%, from 4,109 deaths to 6,283 in 2018.

Additionally, according to the Texas Department of Transportation:

    • Pedestrian fatalities totaled 717 in 2020, which was an 8.47% increase from 2019.
    • 958 individuals were killed in crashes involving drivers who were under the influence of alcohol. This accounted for 25% of the total number of people that were killed in an auto accident.

Shockingly, while pedestrian deaths increased nationally, there was a 13% decrease in the number of miles traveled by drivers in 2020. This means that pedestrians were at greater risk in 2020, despite fewer vehicles on the road and traveling less miles.

Montgomery County Crash Takes 2 Lives and Injures 4 Others

Posted on Thursday, August 5th, 2021 at 1:34 am

A fiery head-on crash killed two women and left four others injured in the early hours of Sunday, Aug. 1, 2021.

Details Regarding the Fatal Accident

Around 1:45 a.m., deputies with the Montgomery County Sheriff’s Office received reports of a major crash near a location on the North Freeway by the Rayford/Sawdust exit in Spring.

According to the authorities, a 25-year-old-woman driving a Honda was traveling the wrong way down the freeway when she collided head-on with a Dodge pickup truck.

The 25-year-old-woman was found dead inside the Honda when deputies arrived at the scene. Nearby, the Dodge pickup truck caught fire with five occupants inside.

Deputies and other first responders tried to extinguish the fire in order to rescue victims from the vehicle, but the fire persisted until firefighters from the Montgomery County Fire Department arrived.

Once the fire was doused, crews attempted to free a 22-year-old passenger trapped inside the pickup truck for nearly 20-minutes. Unfortunately, she was pronounced dead at the scene after life-saving measures failed.

The four other passengers were hospitalized in critical but stable condition. The investigation is ongoing.

What to Do If a Wrong-Way Driver is Traveling in Your Direction

Research by the AAA Foundation for Traffic Safety found that there were 2,921 fatal wrong-way crashes that led to 3,885 deaths from 2010 through 2018.

Here is some helpful advice from AAA if you ever encounter a wrong-way driver heading in your direction:

  • Get out of the way immediately – As soon as you can, move as far to the right as possible, even if there is no shoulder. Try not to swerve off the road and/or into other lanes.
  • Driving at night? Use the center lane – If you find yourself traveling at night, use the center lane so you have the option to move right or left if a wrong-way driver is traveling towards you.
  • Use the right lane on four-lane highways – When traveling on a four-lane highway, it’s advisable to drive in the right lane if you can’t see the taillights of a vehicle in front of you.
  • Don’t slam your brakes – If you can, avoid slamming your brakes. This will help you avoid any potential rear-end collisions if another motorist is traveling behind you.
  • Call 911 as soon as possible – Pullover once it’s safe to do so and contact 911. It’s important to report the vehicle to the authorities to prevent any potential accidents. Provide a description of the vehicle and other relevant information.

3-Vehicle Crash in Austin Leaves 2 Hospitalized with Injuries

Posted on Monday, August 2nd, 2021 at 7:37 pm

A three-vehicle crash in Austin sent two Edinburg residents to the hospital with injuries.

Details Regarding the Crash

The Minnesota State Patrol responded to a three-vehicle crash at Interstate 90 and Highway 218 on the evening of Thursday, July 30.

Police said that three vehicles were traveling eastbound when a Toyota Corolla, driven by a 46-year-old from Austin, attempted to merge into the right lane next to a Dodge Ram. The Dodge Ram braked to avoid a collision and was rear-ended by a 2007 Peterbilt semi-truck.

The driver of the Dodge Ram was identified as a 50-year-old man from Edinburg, TX. His passengers included a 13-year-old female, who was taken to St. Mary’s Hospital in Rochester with life-threatening injuries, and an 11-year-old male who was taken to Mayo Clinic Health Systems in Austin with non-life-threatening injuries. Both passengers are from Edinburg, TX.

Rear-End Collisions and Semi-Truck Crashes

Data published by the National Highway Traffic Safety Administration (NHTSA) has found that rear-end traffic collisions are some of the most common types of traffic accidents reported in the United States.

These accidents account for nearly 28 percent of all motor vehicle crashes and can result in severe personal injuries, especially when a semi-truck or large vehicle is involved.

A report from the Federal Motor Carrier Safety Administration (FMCSA) identified 4,237 semi-trucks crashes between 2015 and 2017. From those crashes, nearly 4,000 involved a fatality and almost 20% were rear-end collisions.

Contributing Factors in Semi-Truck Collisions

According to a study conducted by the FMCSA, the following factors are common in accidents involving large trucks or semi-trucks:

    • Brake malfunction on trucks
    • Poorly lit roads
    • Faulty headlamps or turn indicators
    • Driving under the influence of alcohol and/or drugs

Beyond poorly lit road conditions and brake malfunctions, other contributing factors to consider can include:

    • The driver of the truck did not receive adequate training
    • Truck drivers are encouraged to prioritize quick product delivery rather than safety due to compensation rates based on timely delivery
    • Truck drivers can face overwhelming schedules that can cause fatigued driving

Common Injuries Related to Semi-Truck Rear-End Accidents

Drivers and occupants of cars who are involved in rear-end accidents caused by semi-trucks can suffer life-altering injuries. These include:

    • Neck injuries
    • Back injuries
    • Traumatic brain injuries
    • Burns and scarring
    • Soft tissue injuries

These accidents can cause a great deal of physical and emotional distress, not to mention costly medical bills.

Being involved in a crash with a semi-truck can be a harrowing and life-altering experience. If you or a loved one has been involved in a rear-end accident caused by a semi-truck, you need an experienced attorney that can help you get justice.

How to Confidently Drive on Highways

Posted on Friday, July 30th, 2021 at 3:00 am

Maybe you’re a new driver with some hesitation when it comes to driving over 55 miles per hour, or perhaps you’re an experienced driver with some less-than-stellar highway experiences. Whatever your situation may be, it’s undeniable that highway driving can be challenging.

Data from the Governors Highway Safety Association (GHSA) shows that some of the highest speed limits in the United States can be found in the Lonestar State.

When you consider that information, it isn’t extremely surprising when you learn that there’s 1 reportable car crash in Texas every 56 seconds, according to figures from the Texas Department of Transportation.

Avoid a car crash – be a safer driver by following these highway driving tips and techniques.

Highway Driving Strategies & Safety Tips

1.Don’t drive if you’re feeling impaired in any way.

It should go without saying, but never drink and drive. Driving under the influence of alcohol or drugs is a criminal offense in Texas and can lead to up to 180 days in jail, a fine of up to $2,000, or both.

It’s a mistake to assume that impairment is limited to alcohol or drugs. It can’t be understated how important it is to refrain from getting behind the wheel if you’re feeling tired or drowsy. A report from the National Highway Traffic Safety Administration found that in 2019, there were nearly 700 reported deaths related to drowsy-driving-related crashes.

2.Check the road conditions in advance.

You can keep your chances of getting in a car crash low if you avoid driving in adverse circumstances when possible. In this day and age, it only takes a quick search online to find out whether there’s been a major crash or other situation on the road that you should avoid.

Difficult driving situations can also include:

    • Inclement weather including (but not limited to) heavy rain or snow
    • Rush hour traffic or congested highways
    • Holidays (such as Independence Day or New Year’s Eve), due to the increased possibility of drunk drivers on the highway

It’s not the end of the world if you’re unable to avoid these situations – it just means you’ll have to take extra precautions to ensure your safety. Prioritize keeping a safe distance between yourself and any vehicles traveling in front of you.

Remember that a slower speed can work to your benefit in the event that you need to make a sudden stop or turn. Additionally, be mindful of the traffic ahead for any slowing or stopping to give yourself enough time to act appropriately.

3.Know your lanes.

Picture this: you’re in the middle lane on the highway and the car to your left is driving at the same rate of speed as you are, much to the frustration of the multiple cars behind them who know the left lanes are for faster traffic.

If you want to avoid being that car that holds up traffic, remember that on highways, the left lanes are used by faster traffic, while the right lanes are used by slower traffic.

Be sure to remember that the far-right lane should primarily be used for entering and exiting the highway. The far-left lane is suitable for passing ahead of vehicles. Try to avoid traveling on these lanes exclusively when driving on the highway. It’s recommended to travel on the middle lane when possible.

4.Pass on the left.

To add to the aforementioned tip, try to use the far-left lane when you need to pass another vehicle on the highway.

Generally speaking, it’s safer to pass other drivers on the far-left lane because slower drivers expect those on the left to pass them. When a driver is traveling in the center lane, they can expect the traffic to their right to remain there (since it’s the slower lane), while the traffic to their left is expected to travel at a higher rate of speed.

Regardless of which lane you’re in, remember to always use your turn signal to indicate that you’re changing lanes. Use your mirrors and check over your shoulder to inspect your blind spot before you switch lanes. If possible, avoid driving directly parallel to other cars.

Get the Legal Representation That You Deserve

Each of us maintains a responsibility while traveling on the road, but the reality of the situation is that not every motorist will prioritize safety when driving. Moreover, mistakes can happen even if you are being considerate of yourself and others on the road.

For that reason, it can’t be understated how important it is to have legal representation that you can rely on in the unfortunate event that you’re involved in a car accident.

The experienced car accident lawyers at J. Gonzalez Injury Attorneys can provide you with unmatched legal representation in the Rio Grande Valley to get you the most compensation for your damages and injuries.

2 Dead after Ferrari Driver Loses Control in Houston

Posted on Tuesday, July 27th, 2021 at 8:48 pm

Police are investigating a crash that resulted in the death of two drivers on Westheimer in west Houston on July 26th.

Details About the Fatal Incident

According to the Houston Police Department, the 44-year-old male driver of a white Ferrari was speeding westbound on Westheimer when he lost control on a curve in the road.

After crossing the median, he struck a black Hyundai Elantra that was traveling eastbound. The 57-year-old woman driving the Hyundai was pronounced dead at the scene.

The driver of the Ferrari was transported to Memorial Hermann – Texas Medical Center where he was later pronounced dead.

Police say the investigation is ongoing.

Wrong-Way Accidents in Texas

A recent study from the AAA Foundation for Traffic Safety discovered that there’s been a 34% increase in the number of deaths recorded as a result of wrong-way accidents since 2010.

The report found that 2,008 deaths could be attributed to wrong-way crashes on divided highways from 2015 to 2018, averaging to roughly 500 deaths per year. In Texas, the average rose 29% to 77 fatalities per year from 2015 through 2018 compared to the previous average of 60 deaths from 2010 to 2014.

Unfortunately, wrong-way crash fatalities are more common in Texas than in any other state. From 2015 to 2018, a total of 309 deaths were reported.

Most Common Causes of Wrong-Way Accidents

A special investigation report from the National Transportation Safety Board describes collisions resulting from wrong-way accidents as “one of the most serious types of highway accidents.”

While they tend to happen less frequently when compared to other kinds of accidents, wrong-way accidents have a higher fatality rate. While there are various factors that can contribute to these kinds of accidents, some of the most common are:

    1. Driving under the influence – Intoxicated drivers are involved in 50 to 70 percent of all wrong-way accidents.
    2. Driving while distracted – Drivers who pay more attention to their phones are more susceptible to making mistakes such as merging against traffic or driving the wrong way up a one-way street.
    3. Driver error – Driver error is the most frequent cause of wrong-way accidents, especially in cases with motorists traveling on unfamiliar roads.
    4. Poorly marked ramps – Poorly marked ramps are one of the main reasons that drivers mistakenly enter highway exit ramps.
    5. Drowsy Drivers – Drowsy or tired drivers can fall asleep on the road and lose control of their vehicles, potentially leading to fatal accidents.

Tips for Staying Safe While Traveling to Texas Road Trip Destinations

Posted on Thursday, July 22nd, 2021 at 9:46 pm

A recent survey by ValuePenguin found that 53% of Americans have travel plans.
After a year of quarantine, social distancing protocols, masks, and bad vibes, it’s clear that Americans are eager to get back on the road and have some fun.
Here in the Lone Star State, we have plenty of asphalt to cover – according to the Federal Highway Administration, there are 683,533 total lane miles in Texas. That’s 286,993 more miles than the runner-up state, California.
The Texas Almanac reports that Texas extends 801 straight-line miles from north to south and 773 miles from east to west. Between all that space are enough sights to plan the trip of a lifetime.

Summer Road Trip Safety Tips

Before diving to some popular destinations, it’s important to go over some tips to prepare yourself before hitting the road. The Texas Department of Transportation reported 3,896 deaths on Texas roads in 2020, an increase of 7.54% from the 2019 death toll.
Mistakes happen; if you ever need a car accident attorney, remember that the experienced professionals at J. Gonzalez Injury Attorneys are here to fight for you.
Here are some essential tips to help you avoid mistakes and stay safe during your travels:
1. Make Sure Your Car is Road-Ready – Preparing for a road trip means preparing your vehicle. If you can, schedule a service appointment to handle your regular maintenance. An oil change, battery check, and tire rotations can help your car stay in shape for the journey ahead.
2. Stock up! – If you’re planning on spending hours on the road, try to grab some snacks, toiletries, and car chargers for your trip. More importantly, prepare an emergency kit. A well-rounded emergency roadside kit should consist of a flashlight, a tire jack, jumper cables, road flares, and some duct tape for quick repairs (for example, a temporary fix for a hose leak).
3. Map Out Your Route and Check the Weather – Make sure you have an idea of the route you’ll be taking for your trip. Avoid a headache and familiarize yourself with your directions and maps before you begin your trip. Moreover, check the forecast to see if you need to prepare for any inclement weather on the way to your destination.
4. Book a Place to Stay in Advance – Long drives are hard enough to get through during the day. If you’re the type that prefers to have a good night’s rest over driving through the night, it helps to book a hotel or an Airbnb to get some quality rest and recovery.
5. Get Ready to Travel – Preparing yourself is just as important as preparing your vehicle. To make sure you’re as alert as possible the day of your trip, plan on getting a good night’s rest before you leave. Remember that you’ll be on the road for some time, so dress comfortably.
Following these basic tips can make the difference between a great time on the road and a trip full of disasters. With these tips in mind, let’s go over some factors to consider when planning your Texas road trip.

Plan Your Texas Road Trip Around Your Interests

As mentioned previously, there’s no shortage of must-see destinations in Texas.
The variety of options available to choose from will keep any Texan entertained, whether you’re a college student interested in experiencing a big trip before the next semester starts, or a family eager to get the kids out of the house for some overdue travel.
To help you map out your destinations, consider planning around the interests of your group:
1. For Outdoor Enthusiasts – Fortunately, for outdoor enthusiasts, there’s a great selection of outdoor activities even in the most metropolitan areas of Texas. Perhaps you prefer hiking around mountainous or wooded areas – if that’s the case, then the Big Bend National Park in West Texas makes for a dream destination. If your idea of the “outdoors” involves a sandy beach, the sound of waves, and palm trees, then look no further than South Padre Island for a relaxing getaway destination.
2. For Foodies – The Lonestar State is home to plenty of buzzed-about food locations that can satisfy any foodie. Breakfast hotspots such as Mi Tierra Café and Bakery in San Antonio offer delicious Mexican cuisine to start your day, or consider waking up at 6 a.m. to hop in line at Franklin Barbecue in Austin for some of the best barbecue in the state. Interested in sampling some German cuisine? Look no further than The Auslander in Fredericksburg for some of the finest schnitzel in Texas.
3. For City Lovers – If your group prefers to explore cities and all they have to offer, a great destination to consider is the biggest city in Texas, Houston. This city offers attractions such as Space Center Houston, the Downtown Aquarium, Kemah Boardwalk, and more. Another popular metro area can be found in Dallas, where visitors can browse the Perot Museum of Nature and Science or check out the 360-degree views from Reunion Tower.

Car Crashes into Waco Storefront

Posted on Wednesday, July 21st, 2021 at 4:47 pm

On Tuesday, July 20, a Waco business owner accidentally crashed his vehicle into his business.

Details Regarding the Waco Storefront Collision

According to police, the owner of a package shipping store crashed into the front of the building after accidentally stepping on the gas pedal. The vehicle accelerated forward and shattered through the glass storefront.

Though people were inside the business at the time of the accident, police advised that there were no reported injuries. There’s no word of citations or charges being issued at this time.

What Causes Vehicle-into-Building Crashes?

Storefront crash statistics collected from 2012 to 2020 show that adults ages 20 through 29 are responsible for 20% of these incidents. The most recent data from 2020 indicates that retail stores are the most frequent locations of vehicle-into-building crashes.

The research also shows the two most common reasons behind these accidents include operator error and pedal error (19%), amongst other causes.

Operator error accounts for 22% of vehicle-into-building crashes, with pedal error accounting for 19%. Common reasons involved in operator error incidents include sudden or unexpected acceleration, speeding, or operating the vehicle while in the wrong gear. Pedal error incidents are often the result of drivers mistaking their accelerator for their brake pedal.

What to do After a Vehicle-into-Building Car Crash

One of the first things you want to do if you’ve been involved in a collision with a building is to remain calm and remember to stay at the scene of the accident. In many cases, it is against the law to flee the scene of an accident.

Once you’ve composed yourself, contact the local authorities to secure the scene and assess the situation to ensure the space is safe. It’s best to file an accident report for insurance purposes.

Additionally, try to locate the owner of the building or home to share your car insurance information and also inquire about their insurance.

ATV Crash In Pharr Leaves Woman Dead, Man Injured

Posted on Monday, July 19th, 2021 at 6:32 pm

On Sunday, July 18, an all-terrain vehicle (ATV) crash left a Pharr woman dead and a man injured.

Details About the Incident

Pharr police were called to a canal bank near 600 E. Las Milpas Road around 8:30 p.m.

According to a press release from the authorities, the ATV accident involved two riders losing control and rolling over into a 15 to 20-foot deep canal. The driver, a 22-year-old-man, was driving the ATV with a 22-year-old woman seated behind him.

Pharr police reported that the woman died at the scene. The victim’s family has been notified. The man suffered minor injuries that were treated at the scene.

Police say the investigation is ongoing and that additional information will be released at a later time.

Texas Has the Most Reported Deaths Associated with ATVs in the United States

Often considered a fun and exciting past-time, the last thing on anyone’s mind during an ATV ride is an accident. Unfortunately, ATV accidents are more common than you think – especially in Texas.

The United States Consumer Product Safety Commission (USCPSC) reported 831 ATV-related fatalities have occurred in Texas from 1982 to 2017.

If you’ve been involved in an ATV-related accident, J. Gonzalez Injury Attorneys have the experience to help you make a case or claim.

Thinking of Riding an ATV? Here’s How to Prepare for Success

Before riding an ATV, it’s important to understand the risk. Though a fun activity, ATV-related accidents can result in death or in serious injuries such as:

      • Internal bleeding
      • Cerebral contusion
      • Traumatic brain injury
      • Broken arms
      • Broken ribs and more

The best way to avoid an ATV-related accident is by taking the necessary steps to prepare for riding. These steps include:

1. How to Ride an ATV Properly – Don’t get caught in a situation that could have been prevented if you had learned some essential riding techniques. Private and public ATV safety courses are options in most states, and can prepare you to safely and confidently ride an ATV.

2. Ride with Protective Gear – Even the most experienced ATV driver can be involved in an accident. Protective gear such as helmets, boots, gloves, and goggles can help prevent serious injury in the event of an accident.

3. Be Aware of Your Boundaries – It’s important to know your boundaries and limits when riding an ATV. Understanding how much power your ATV has and how to control it is a factor that most casual riders overlook. Additionally, it’s extremely important to be aware of your surroundings when driving, especially if you’re in an unfamiliar area.

Pedestrian Killed in Houston Crash

Posted on Friday, July 16th, 2021 at 9:40 pm

On Thursday, July 15, a Houston man was killed after being struck by a car along the North Freeway feeder road in North Harris County.

Details About the Incident

A motorist was northbound on the feeder road when a young pedestrian suddenly attempted to cross the road. According to reports, the driver of the vehicle attempted to swerve to avoid collision but was unable to avoid the crash.

The driver remained on the scene and cooperated with the authorities. The pedestrian, whose identity was not immediately identified, was pronounced dead at the scene.

The motorist isn’t likely to face any charges related to the accident.

What Should I Do Immediately Following a Traffic Accident with a Pedestrian?

According to the Governors Highway Safety Association (GHSA), 2020 preliminary data reported by the State Highway Safety Offices (SHSOs) projects that 6,721 pedestrians were killed on U.S. roads in 2020. That’s nearly one death every 79 minutes.

It should go without saying that, unfortunately, these accidents are more common than most would assume. If you ever find yourself in this terrible situation, it’s important that you take action immediately:

    • Call 911: One of the very first things you should do is call 911 to provide medical aid to any injured persons and alert the authorities. Besides attempting CPR in an emergency, it’s important that you don’t attempt to administer medical treatment beyond your capabilities.
    • Assess the Damage: Once local law enforcement arrives, you will need to file an accident report. Whether you’re at fault or not, it’s important to note as many details as you can. If possible, use your smartphone to photograph the scene.
    • Call Your Insurance Company: Inform your auto insurance provider of the situation. It’s natural for the responsible company to begin apologizing as well as citing fault. It’s crucial that you remain calm and aware of what you say, as your words can be used against you. If the accident wasn’t your fault, don’t apologize or take full or partial blame either.
